EPS 95: खुद कोर्ट की सला95 ह है कि आवेदन करके उन्हें अवगत कराया जाय कि किसी प्रकरण की सुनवाई तत्काल करने को क्यूँ उपयुक्त समझा जाये।इंसान की जिंदगी से बढ़ कर और क्या कारण हो सकता,जहाँ उम्रदराज पेंशनर्स रोजाना सतगति को प्राप्त हो रहे हों, क्या अभी तक किसी ने भी ऐसा प्रयास नहीं किया ? शायद इसीलिए हमें सिर्फ तारीख ही मिल रही हैं,हमारे प्रकरण को URGENT HEARING के लिए उचित कभी माना ही नहीं गया।इस पर किसी को कुछ कहना है तो बताए कि हमारे साथ ऐसी स्तिथि किन कारणों से हुए जा रही है।

In continuation of Standard Operating Procedure (SOP) dated 04.07.2020 and circular(s) issued earlier regarding mentioning of matter(s), it is hereby notified for the information of all concerned:

EPS 95 Pensioners Higher Pension News: Very Important Information for 65 Lakh EPS 95 Pensioners, Supreme Court Higher Pension Cases Order


EPS 1995 पैंशन वाद पर बहस करने के लिये केवल दो ही मुद्दे है तीसरा नही अत: बहस कम से कम आधा दिन व अधिकतम् दो दिन हो सकती है। EPS 1995 पैंशन योजना केवल अंशदान पर आधारित है अत: नियोक्ता 8.33% के अनुसार जितना अंशदान , EPFO के द्वारा संचालित पैंशन फण्ड मे जमा करायेगा, उसी के अनुरूप EPFO पैंशन निर्धारित करेगी , केन्द्र सरकार का अंशदान 1.67% होगा।


अब आता हू बिन्दू संख्या एक जिस पर बहस होनी है, वह है 31/5/2017 की ऐडवाइजरी। सुप्रिम कोर्ट निर्णय दिनाक 4/10/2016 सीधे लागू नहि हुऐ ओर न ही EPFO ने दिनाक 23/3/2017 के आदेश सीधे जारी किये।सुप्रिम कोर्ट के उक्त निर्णय  पर पांच संस्थाओ मे मंथनो पश्चात निर्देश जारी किये, जारी निर्देशो की अनुपालना करते हुये ही EPFO ने दिनाक 23/3/2017 को आदेश जारी किये।

जब कि EPFO ने  बिना किसी उक्त संस्थाओ की स्वीकृती के अपने स्तर पर दिनाक 31/5/2017 की ऐडवाइजरी जारी की जिसे KHC ने अपास्त कर दिया। सुप्रिम कोर्ट 31/5/2017 की ऐडवाइजरी को अपास्त ही रखेगा क्यो कि अपास्त नही करने पर उक्त पांच संस्थाओ के अस्तीत्व पर प्रश्न चिन्ह लग जायेगा जिसमे सम्बन्धित मंत्रालय भी सम्मीलित है । उक्त तर्क के आधार पर बहस मे दम नही है अत: सुनवाई कितनी देर चलेगी?

दूसरा बिन्दू GSR No. 609 है जिस पर बहस होनी है GSR No. 609, GOI का एक Policy matter है जिसे KHC ने अपास्त कर दिया। केन्द्र सरकार की कार्यप्रणाली केवल Policy matter पर आधारित है क्यो कि किसी भी कार्य को करने से पहले GOI के द्वारा सम्बन्धित Policy matter बनाया जाता है तत्पश्चात उस पर कार्यवाही सूनिश्चित की जाती है बिना Policy matter के कोई कार्य सम्पादन नही होता  ऐसी स्थिति मे KHC के द्वारा GSR No. 609 को अपास्त करना GOI को कार्यवाही करने से रोकना है, यदि सुप्रिम कोर्ट KHC के निर्णय को यथावत रखती है तो कल दूसरी Policy को भी निरस्त करने के लिये कोर्ट मे वाद दायर होना निश्चित है अत: सुप्रिम कोर्ट विषम परिस्थितियो को ध्यान मे रखते हुऐ GSR No. 609 को पुन: यथावत जारी रखने के आदेश जारी कर सकती है। बहस मे दम है अत: सुनवाई एकाध दिन चल सकती है।

After hearing all miscellaneous matter, SC took up Item 1 of Regular matters which is NOIDA Vs KENDRIYA KARAMCHARI SEHKARI G.N.SAMITI. After hearing Item 1 partly, Justice Mr. Lalit said, DAICHII mater will take 4 days of Non Miscellaneous Days (ie) 2 days in this week & 2 in the next week. and as the roster will be changed from 26.4.21, he would take up the Item 1 again on 22.4.21 (Thursday).


Therefore, EPS 95 Pensioners cases will likely to be listed only after 27 April 21. Bench also may be different.

We may come to know the date of next hearing only by today evening. Regarding bench, we will come to know later.

Good News For Pensioners, Employees: महंगाई भत्ते (DA), महंगाई राहत (DR) को लेकर कर्मचारियों, पेंशनधारकों के लिए बड़ा लाभ?


केंद्र सरकार के कर्मचारी महंगाई भत्ते (DA) का बेसब्री से इंतजार कर रहे हैं, जो जनवरी 2021 तक वापस आ गया था। अखिल भारतीय उपभोक्ता मूल्य सूचकांक (AICPI) के आंकड़ों के अनुसार, कम से कम 4 प्रतिशत DA बढ़ोतरी की उम्मीद की जा सकती है। जनवरी से जून 2021 की अवधि के लिए। लेकिन, डबल बोनस भी है क्योंकि केंद्र को 1 जुलाई से डीए बहाल करने की उम्मीद है क्योंकि उन्होंने डीए बढ़ोतरी को रोक दिया है। यह सेवानिवृत्त केंद्र सरकार के कर्मचारियों के लिए भी अच्छी खबर होगी क्योंकि उनके महंगाई राहत (डीआर) का लाभ भी कम से कम बहाली के साथ बहाल हो जाएगा। उस स्थिति में, यह लगभग 52 लाख केंद्र सरकार के कर्मचारियों और केंद्र सरकार के लगभग 60 लाख पेंशनभोगियों के लिए अच्छी खबर होगी।

DA बहाली के बाद, केंद्र सरकार के कर्मचारीयों को मौजुदा 17 प्रतिशत से 28 प्रतिशत (17 + 3 + 4 + 4) से बढ़ोतरी हो सकती है। इसमें जनवरी से जून 2020 के लिए घोषित 3 प्रतिशत DA, जुलाई से दिसंबर 2020 के लिए घोषित 4 प्रतिशत DA और जनवरी से जून 2021 तक 4 प्रतिशत DA की उम्मीद है।

जैसा कि केंद्र सरकार के कर्मचारियों के वेतन का निर्धारण फिटमेंट फैक्टर (जो 2.57) है, को मूल वेतन प्लस डीए से गुणा किया जाता है। जब डीए 17 से 28 प्रतिशत तक बढ़ जाएगा, तो एक केंद्रीय सरकारी कर्मचारी का वेतन कूदने के लिए बाध्य होगा। इसके अलावा, उन्हें डीए बकाया की तीन किस्तें भी दी जाएंगी।

केंद्रीय सरकारी कर्मचारियों की तरह, 60 लाख पेंशनभोगियों को भी DR बहाली का लाभ मिलेगा क्योंकि उनकी पेंशन उसी तरह से बढ़ेगी जिस तरह से एक केंद्रीय सरकारी कर्मचारी का वेतन बढ़ेगा। DA की घोषणा के बाद, उनका DR ऊपर जाएगा और उस स्थिति में, उनकी मासिक पेंशन बढ़ेगी और उन्हें अपने DR की तीन किस्तों के लिए एरियर भी मिलेगा।

EPS 95 PENSIONERS NEWS TODAY: EPS 95 पेंशनधारकों पर ईपीएफओ के अन्याय के विरोध में राष्ट्रीय संघर्ष समिति का देशव्यापी विरोध प्रदर्शन आज

राष्ट्रीय संघर्ष समिति मंगलवार को कर्मचारी भविष्य निधि संगठन के खिलाफ देशव्यापी विरोध प्रदर्शन करने जा रही है। 20 मार्च 2021 के ईपीएफओ पत्र की एक प्रति जलाकर विरोध प्रदर्शन किया जाएगा।

EPS- 95 के राष्ट्रीय संघर्ष समिति के राष्ट्रीय अध्यक्ष कमांडर अशोक राउतजी ने कहा, “एक तरफ, माननीय प्रधान मंत्री ने खुद हमें ईपीएस -95 पेंशनरों की उचित मांगों को मंजूरी देने के लिए 4.3.2020 पर सीधा आश्वासन दिया है। उन्होंने संबंधित मंत्री को उचित समाधान के निर्देश भी दिए हैं। साथ ही सभी आंदोलन वापस लेने की सलाह दी गई है और उसी सलाह के अनुसार राष्ट्रीय संघर्ष समिति, बुलढाणा (महाराष्ट्र) के मुख्यालय में पिछले 834 दिनों से क्रमिक अंशन को छोड़कर सभी आंदोलन वापस ले लिए गए हैं, लेकिन दूसरी ओर कर्मचारी भविष्य निधि संगठन ने अन्याय के मार्ग में कोई कसर नहीं छोड़ी और पेंशन धारकों के खिलाफ अत्याचार जारी है।

EPFO का परिपत्र दिनांक 23 मार्च 2017, जिसमें उच्चतम न्यायालय के दिनांक 4 अक्टबर 2016 के आदेश में उच्च पेंशन देने का आदेश दिया गया है, उस सर्कुलर को सर्वोच्च न्यायालय को दिए बिना, पूर्ववर्ती रूप से ईपीएफओ की तिथि निर्धारित की गई है। 20 मार्च 2021 के आदेश के अनुसार, इसे अमल में लाने से दूर रखा गया है।

EPFO ​​ने सुप्रीम कोर्ट के अटॉर्नी जनरल को पेंशन संबंधी मामलों के संबंध में सही जानकारी नहीं दी। साथ ही श्रम पर संसदीय समिति को श्रम सचिव द्वारा सही तथ्यों, अनुचित मुद्दों को प्रस्तुत किए बिना प्रस्तुत करना, आदि शामिल है।


उपरोक्त सभी मुद्दों पर विचार करते हुए, देशव्यापी स्तर पर EPFO के सभी कार्यालयों में EPFO के अन्यायपूर्ण कृत्यों का विरोध करते हुए सच्चाई क्या है? पेंशन की सही जानकारी और भावनाओं को भारत के माननीय प्रधान मंत्री / मुख्य न्यायाधीश के सामने लाया जा सकता है, इसलिए ये विरोध कार्यक्रम देश के EPS- 95 पेंशनरों द्वारा किया जा रहा है।

यह ज्ञात होना चाहिए कि कोरोना महामारी के कारण, EPS 95 पेंशनधारक शासन / प्रशासन के सभी नियमों को ध्यान में रखते हुए इस "विरोध कार्यक्रम" में भाग लेंगे। दिनांक 06 एप्रिल 2021 इस विरोध दिवस के कार्यक्रम में, तथाकथित पत्र दिनांक 20 मार्च 2021 की एक प्रति जलाई जाएगी, और मा. प्रधानमंत्री के नाम ज्ञापन संबंधित EPFO कार्यालयों में दिया जाएगा।


EPS 1995 पेंशनधारकों के मांगें इस प्रकार हैं

1. न्यूनतम मासिक पेंशन रु. 7500 और महंगाई भत्ता दिया जाना चाहिए।

2. कर्मचारी भविष्य निधि संगठन का अंतरिम पत्र 31 मई 2017 को  वापस ले ली जाए और पेंशनरों को EPS 1995 पेंशनधारकों को सर्वोच्च न्यायालय के आदेश के अनुसार, उच्च पेंशन का विकल्प दिया जाना चाहिए।

3. सभी ईपीएस -95 पेंशनरों और उनके जीवनसाथी को मुफ्त चिकित्सा सुविधा प्रदान की जानी चाहिए।

4. सेवानिवृत्त कर्मचारी जो EPS- 95 योजना के सदस्य नहीं हैं, उन्हें ब्याज के साथ योगदान की वसूली करके और उन्हें बकाया राशि का उचित भुगतान करने की अनुमति देकर पूर्व पद सदस्यता दी जानी चाहिए अन्यथा उन्हें रु. 5000 की पेंशन राशि प्रति माह तय किया जा सकता है।
