Dear EPS 95 Pensioners Friends,

There may be about 70 lakhs EPS pensioners in the country. They are, curiously awaiting decisions from 2 institutions. One is the Central Government ie Mr. Modi the supreme leader. The second one is the Supreme Court, the highest judiciary of the country.

Mr. Modi was propitiated many times by many leaders including leaders of the party in the ruling. They have many times, many statements gave cajoling pensioners that Mr. Modi heard them attentively and ordered for immediate consideration and a decision. One of them was Mrs. Hema Malini Member of Parliament BJP and a celebrity from the cine field. What they said was that they have pleaded with Mr. Modi was a minimum pension of Rs 7500/. The leaders who were along with these MPs gave statements that Mr. Modi was very considerate in hearing them and they conveyed to their grass root level followers that Mr Modi is going to take a favourable decision.


Mr Javedekar who during the 2014 elections made several statements once the BJP  comes to power will implement Koshiyari recommendations and grant DR linked minimum pension of Rs 3000/. BJP came to power twice in 2014 and 2019 and Mr. Javdekar continues to cabinet minister since 2014. But this great leader never bothered to raise the issue in public or in the cabinet.



Now the High Empowered  Monitoring Committee appointed by the government recommended Rs 2000/as minimum pension. Minister for labour replied in the parliament that they are not in a position to implement recommendations. This is the statement for Rs 2000/ minimum pension. After being in power for the last 7 Years. We failed to take the validity of statements like ELECTION JUMLA and continue to have hope for the party in power. This poor EPS pensioner had/have great expectations from BJP. That is where EPS pensioners are stranded.



The second hope was from the judiciary. Supreme Court judgment on higher on 16-10-2016 and Upholding of Kerala Court judgment (12-10-2018) on 01-04-2019. EPS pensioners had confidence that the government will honor the Judgements of the Supreme Court. Years and years are passing. Pensioners are monitoring

the posting of the cases in the itinerary of the supreme Court, Three Chief judges have come and gone but no decision on the cases. Mr. Gogai Came and retired. Mr. Bobde came and retired. Mr. Bobde had vo conceded to the government and withdrawn the judgment on 01-04-2019.EPS pensioners hopes are totally belied the hopes on Judiciary.



Now EPS pensioners are facing the 2nd wave of the Corona pandemic. Many have become prey to this pandemic and left this world without achieving minimum pension. This notorious government did not heed to consider minimum financial relief as was given to the workers in service in the form of paying EPF contribution for 6 months.

We can name the industries like Sugar private, cooperative, Beedy, cement, quarry and many more pri ate Industries.



Now, this corona is robbing remnants of the poor including EPS pensioners had. EPS pensioners are unable to organize themselves. In a perplexing situation. We have no other go except to wait. But when time cones EPS pensioners had to rise like one man. Let us prepare and wait for that event.

EPS 95 Pension Hike, Higher Pension News: Appeal to Supreme Court & Government of India to Allow Higher Pension & 7500+DA to EPS 95 Pensioners

APPEAL TO SUPREME COURT & Government of India


Many High Courts in India have placed Orders in favor of Employees pertaining to Exempted PSUs for availing the full pension option in line with SC judgment. Many exempted PSUs from EPFO are enjoying the FULL PENSION options already.

Selected PSUs that are exempted from EPFO are only denied by EPFO. It is a sheer personal vendetta by an IAS Officer. However, to our dismay, many Exempted PSUs are enjoying these full pension options. Is it not partial treatment?


Sr Citizens are dying daily. Corona too takes away our brothers and sisters.  The SC judges and Registry have been dilly-dallying our Review Petition. There is no fellow human being and sense of responsibility in giving utmost priority to the LEGITIMATE GENUINE PENSION DEMANDS OF SR CITIZENS.

Please share this appeal as much as possible so that it is tabled on SC Judges and PM of India. At least let the survivors of Sr Citizens of India get the benefits of EPS95 pension before they kick their buckets.

EPS 95 Higher Pension Cases Hearing News: देश के 67 लाख EPS 95 पेंशनधारकों का बढ़ा इंतजार, भारत के मुख्य न्यायाधीश ने लिया बड़ा फैसला, EPS 95 पेंशनधारकों मामलों पर फिर से अनिच्छितता

देश के लगभग 67 लाख EPS 95 पेंशनधारक सुप्रीम कोर्ट में दाखिल EPS 95 पेंशनधारकों से जुड़े हुए हायर पेंशन के मामलों के पर सुनवाई के लिए इंतजार कर रहे हैं। EPS 95 पेंशनधारकों को आशा थी कि उनके मामलों पर 23, 24, 25 मार्च 2021 को सुनवाई हो जाएगी पर ऐसा नहीं हुआ और इन्हें 15 मार्च 2021 तक के लिए टाल दिया गया था। उसके बाद इन मामलों को 15 मार्च की जगह फिर से 22 अप्रैल 2021 तक के लिए टाल दिया गया था, पर उसी बीच सुप्रीम कोर्ट द्वारा एक सर्कुलर जारी किया जिसमें कोविड-19 की स्तिथि को देखते हुए 22 अप्रैल 2021 से केवल महत्वपूर्ण मामलों को सुनवाई के लिए लिया जाएगा ऐसा कहा गया।


इसकी वजह से जो 22 अप्रैल 2021 को EPS 95 पेंशनधारकों से जुड़े हुए लगभग 60 मामले सुनवाई के लिए सूचीबद्ध किए गए थे तो उनकी जगह पर केवल 6 मामलों को सुनवाई के लिए लिया गया और EPS 95 पेंशनधारकों से जुड़ा हुआ एक भी मामला 22 अप्रैल 2021 को सुनवाई के लिए नहीं लिया गया।

उसके बाद हाल ही में भारत के मुख्य न्यायाधीश एन. वी. रमना ने बार के सदस्यों के साथ परामर्श के बाद दिल्ली में COVID-19 स्थिति के मद्देनजर शीर्ष अदालत की गर्मियों की छुट्टी को एक सप्ताह पहले ही शुरू करने के लिए सहमत हुए हैं । जिसकी वजह से EPS 95 पेंशनधारकों के मामलों के ऊपर जो अगली होने वाली सुनवाई है वह कब होगी इसके बारे में कोई अपडेट नहीं है।

एक बार फिर से 95 पेंशनधारकों के मामलों की सुनवाई के ऊपर अनिच्छितता दिखाई दे रही है क्योंकि जो गर्मियों की छुट्टियों को 1 सप्ताह पहले ही शुरू करने का फैसला लिया गया है। जिसकी वजह से अब EPS 95 पेंशनधारकों को 27 जून तक का इंतजार करना पड़ेगा क्यों कि 27 जून 2021 तक सुप्रीम कोर्ट को गर्मी की छुट्टि होगी। यानी इस दौरान सुप्रीम कोर्ट का कोई भी कामकाज नहीं होगा।

सुप्रीम कोर्ट का कामकाज 28 जून 2021 से शुरू होगा उसके बाद ही EPS 95 पेंशनधारकों के मामले हैं तो उनके ऊपर कब फैसला होगा तो इसके बारे में जानकारी मिल सकती है।


सुप्रीम कोर्ट बार एसोसिएशन (SCBA) के प्रतिनिधियों और सुप्रीम कोर्ट एडवोकेट ऑन रिकॉर्ड एसोसिएशन (SCAORA) और बार काउंसिल ऑफ इंडिया के साथ भारत के मुख्य न्यायाधीश एन. वी. रमना द्वारा आपात बैठक में निर्णय लिया गया ।

साथ ही भारत के मुख्य न्यायाधीश एन. वी. रमना ने कम से कम 60 बेड और अन्य सुविधाओं जैसे RT-PCR परीक्षण, COVID-19 टीकाकरण आदि के लिए चिकित्सा सुविधाओं की स्थापना के लिए उपयुक्त क्षेत्र प्रदान करने के लिए भी मंजूरी दी है।

SCBA अध्यक्ष विकास सिंह के अनुसार, भारत के मुख्य न्यायाधीश एन. वी. रमना ने अधिवक्ताओं के चैंबर ब्लॉक को COVID केयर यूनिट के रूप में उपयोग करने के लिए मंजूरी दी है।


तहसीलदार चाणक्यपुरी को व्यवस्था करने के लिए संक्षिप्त किया गया है ताकि भवन का निरीक्षण किया जा सके।

सुप्रीम कोर्ट बार एसोसिएशन (SCBA) ने इससे पहले भारत के मुख्य न्यायाधीश को लिखा था कि अप्पू घर परिसर में नवनिर्मित अधिवक्ता चैंबर बिल्डिंग को COVID-19 केयर सेंटर में बदलने के लिए वकीलों, कोर्ट स्टाफ और उनके परिवारों के हित के लिए जो COVID-19 केयर सेंटर में बदलें।

इस बड़े फैसले से फिलहाल EPS 95 पेंशनधारकों मामलों पर कब सुनवाई होगी इसके बारे में अभी कोई अपडेट नहीं है 22 अप्रैल को जो मामले सुनवाई के लिए सूचीबद्ध किए गए थे तो उन पर भी सुनवाई नहीं हुई है। ऐसे में गर्मियों की छुट्टियों का ऐलान सुप्रीम कोर्ट द्वारा कर दिया गया है और उसे भी 1 सप्ताह पहले से ही शुरू करने का फैसला लिया गया है। इसकी वजह से अभी EPS 95 पेंशनधारकों को और लंबा इंतजार करना होगा। उम्मीद की जा रही थी कि पिछले महीने यानी 23, 24, और 25 मार्च को जो सुनवाई शुरू हुई थी तो उन सुनवाई के दौरान भी कोई अंतिम फैसला आ जायेगा पर EPS 95 पेंशनधारकों के मामलों को बार-बार टाल दिया गया जा रहा है।


23 24, 25 मार्च की सुनवाई के लिए 59 याचिकाएं क्रमांक 15 न्यायालय संख्या 3 में सूचीबद्ध थी। जिनमे से एक मामले की सुनवाई यानी SLP NO. 20,417/2017 जो की M/S Daiichi Sankyo Company Ltd बनाम OSKAR Investments Ltd पर सुनवाई होने के बाद सुनावाई हुई थी। उसके बाद EPS 95 मामलों को लिया जाना था। पर EPS 95 पेंशनधारकों को एक बार फिर से 13 अप्रेल 2021 फिर 15 अप्रेल 2021 और 22 अप्रेल 2021 को सुनवाई होनी थी।

Not a single pair has been allotted in Budget.neither nor submitted any favourable Proposals to government for e.p.s 95 to increase the Pension by EFO in your resume also. In this regard. It should be acted upon on it, sir as per the provisions of scocial, constitutional fundamental Rights and Main Aims of EPFO which are Declared by Advertising d/-16 th November 1995.


Hon’ble Shri Neeraj Dangi M.P. Smt. Hema Malini, Smt. Navnit Rana, Shri Rajmani Patel, Shri Dharyasheel Mane and other M.P.s raised questions  In Loksabha and Rajyasabha 'Question hours' about the need to increase minimum meagre Pension from Rs. 1000/-to 9000/- + D.A Per Month.

A lot of representations have been given by us and various Trade Unions, EPS 95 Pensioners Associations demanded  to increase the minimum Pension with the amendment in the act, with consideration and the support with submitted amendment Report of Bhagat Singh Koshiyari Committee. In the year 2014 Unon Government had already been asked to EPFO about the implementation of Bhagatsing Koshiyari's report and how much amount is to be required. EPS 95 Pensioners Higher Pension News: Very Important Information for 65 Lakh EPS 95 Pensioners, Supreme Court Higher Pension Cases Order


EPS 1995 पैंशन वाद पर बहस करने के लिये केवल दो ही मुद्दे है तीसरा नही अत: बहस कम से कम आधा दिन व अधिकतम् दो दिन हो सकती है। EPS 1995 पैंशन योजना केवल अंशदान पर आधारित है अत: नियोक्ता 8.33% के अनुसार जितना अंशदान , EPFO के द्वारा संचालित पैंशन फण्ड मे जमा करायेगा, उसी के अनुरूप EPFO पैंशन निर्धारित करेगी , केन्द्र सरकार का अंशदान 1.67% होगा।


अब आता हू बिन्दू संख्या एक जिस पर बहस होनी है, वह है 31/5/2017 की ऐडवाइजरी। सुप्रिम कोर्ट निर्णय दिनाक 4/10/2016 सीधे लागू नहि हुऐ ओर न ही EPFO ने दिनाक 23/3/2017 के आदेश सीधे जारी किये।सुप्रिम कोर्ट के उक्त निर्णय  पर पांच संस्थाओ मे मंथनो पश्चात निर्देश जारी किये, जारी निर्देशो की अनुपालना करते हुये ही EPFO ने दिनाक 23/3/2017 को आदेश जारी किये।

जब कि EPFO ने  बिना किसी उक्त संस्थाओ की स्वीकृती के अपने स्तर पर दिनाक 31/5/2017 की ऐडवाइजरी जारी की जिसे KHC ने अपास्त कर दिया। सुप्रिम कोर्ट 31/5/2017 की ऐडवाइजरी को अपास्त ही रखेगा क्यो कि अपास्त नही करने पर उक्त पांच संस्थाओ के अस्तीत्व पर प्रश्न चिन्ह लग जायेगा जिसमे सम्बन्धित मंत्रालय भी सम्मीलित है । उक्त तर्क के आधार पर बहस मे दम नही है अत: सुनवाई कितनी देर चलेगी?

दूसरा बिन्दू GSR No. 609 है जिस पर बहस होनी है GSR No. 609, GOI का एक Policy matter है जिसे KHC ने अपास्त कर दिया। केन्द्र सरकार की कार्यप्रणाली केवल Policy matter पर आधारित है क्यो कि किसी भी कार्य को करने से पहले GOI के द्वारा सम्बन्धित Policy matter बनाया जाता है तत्पश्चात उस पर कार्यवाही सूनिश्चित की जाती है बिना Policy matter के कोई कार्य सम्पादन नही होता  ऐसी स्थिति मे KHC के द्वारा GSR No. 609 को अपास्त करना GOI को कार्यवाही करने से रोकना है, यदि सुप्रिम कोर्ट KHC के निर्णय को यथावत रखती है तो कल दूसरी Policy को भी निरस्त करने के लिये कोर्ट मे वाद दायर होना निश्चित है अत: सुप्रिम कोर्ट विषम परिस्थितियो को ध्यान मे रखते हुऐ GSR No. 609 को पुन: यथावत जारी रखने के आदेश जारी कर सकती है। बहस मे दम है अत: सुनवाई एकाध दिन चल सकती है।

EPS 95 PENSIONER CASE STATUS 13.04.2021: Good News for 65 Lakh EPS 95 Pensioners from Supreme Court EPS 95 Cases Considered for Hearing

After hearing all miscellaneous matter, SC took up Item 1 of Regular matters which is NOIDA Vs KENDRIYA KARAMCHARI SEHKARI G.N.SAMITI. After hearing Item 1 partly, Justice Mr. Lalit said, DAICHII mater will take 4 days of Non Miscellaneous Days (ie) 2 days in this week & 2 in the next week. and as the roster will be changed from 26.4.21, he would take up the Item 1 again on 22.4.21 (Thursday).


Therefore, EPS 95 Pensioners cases will likely to be listed only after 27 April 21. Bench also may be different.

We may come to know the date of next hearing only by today evening. Regarding bench, we will come to know later.
