EPS 95 PENSION CASES HEARING: The never- ending saga continues with the hearing again postponed to 13.04.21.

The never- ending saga continues with the hearing again postponed to 13.04.21.

You have seen the different  arguments, often ridiculous and silly,  put forth by EPFO, against our pleas, all these years. Now it has come up with the idea of paucity of funds as a final resort. And, Sir even if the SC orders in our favour the EPFO, finds another  lame excuse to avoid implementation this we all know and experienced time and again.

Sir, it really beats us why the EPFO has to resort to such blatant lies. One reasonable doubt and explanation could be that the entire fund of lakhs of rupees has been diverted and exhausted already.

Furthermore, hundreds of crores coming in, every month, by way of contributions is a lucrative source.

They are able to play this game just throwing a few bucks( less than 1000 rupees)  on our face taking safe shelter under the Act with multiple flaws.

It  thus, want to survive the threat of making good lakhs of crores, diverted so far.Our leader Sri.Prasada Reddy garu has furnished the financial data of EPFO that as on 31.03.2020; the total corpous of EPFO, is nearly 5.31 lakh crores interest earned is 39,042 crores.

While the amount of pension disbursed is 11,321 crores only. That is pension disbursed is less than 29% of the total Interest accrued balance of 71% amount goes into Corpus or into black hole???Can we find any other plausible reason for this adamant and constantly evasive attitude of EPFO, for all these years.

Kindly offer your opinion and remarks. Thanks

We are covered under a Welfare Scheme devised and implemented by Central Government. Contributions are collected from our employers and from us it has been made mandatory you have no liberty to be exempted. The pensioners of Central government do not contribute even a single rupee. And yet, they are paid huge pension (nearly 50- times more than us) plus DA revised upwards, every 6 months.

Why this discrimination ??

If the ruling class has real sympathy towards us, the aged and ailing, they can absorb our entire corpus amount of nearly 6- lakh crores into Consolidate Fund of India (from where the pension amount of Central government pensioners is drawn and paid) and pay us on par with the pensioners of Central government. There seems to be no big problem here....except *there is no corpous fund left must be totally dry...escaped into black hole.

Kindly enlighten us anything in contrary, of course, with valid reasons Thanks a lot.

No.EPS95 / NAC / VVIP / Protest / 3003 Dt.30.03.2021

To,

The Hon'ble Minister of Labour and Employment

Govt.of India,

New Delhi

Subject: - Countrywide programme for submission of Memorandum to the Hon Prime Minister on dated 06.04.2021 through all the EPFO offices to protest against the unjust behavior of the Employees Provident Fund Organization.

Reference: - This organisation Letter No.EPS95 / NAC / VVIP / 2103 Dtd.21.03.2021.

Hon Sir,

Your good self is aware that on the one hand, the Hon'ble Prime Minister promised us to fulfill the most reasonable demands of the EPS 95 Pensioners when the delegation led by Mrs. Smt Hema Malini ji had an Honour to meet him on dated 4.3.2020 . During the meeting held, a direct assurance has been given and instructions have also been passed to the Ministers concerned for resolving the EPS 95 Pensioner's demands. Since then all the pensioners are looking at the Prime Minister with hopeful eyes.

According to the advice of the Hon'ble Minister for Labour and Employment the ongoing thousands of agitations from Tehsil level to Delhi level by the NAC have been withdrawn (except for the chain hunger strike for the last 825 days of Buldhana Maharashtra).

However, on the other hand, the employees' provident fund organization continues to do injustice to pension holders.

For example -

1. Regarding higher pension on actual salary , the truth is that even after the provision in the original scheme, the higher pension on actual salary is not being given by the EPFO. Unfortunately, the poor old age Pensioners pensioners had to knock the doors of courts.

These matters continue for many years. Though the pensioners have been getting justice through hard fought battles at the courts. Finally in RC Gupta's case, it came to the notice of the Hon Supreme Court that many departments did not even gave timely information about the option for higher pension to the employees. Some departments While not giving any information to the employees, it was mutually decided between themselves and the EPFO that higher pension on actual salary is not in the interest of the employees (for example the decision dated 31.5.1997 taken by the MSEB administration is presented) nor did the EPFO implement it.

Considering all these elements, the Hon'ble Supreme Court ordered "Higher Pension on Actual salary" on 4.10.2016 on the basis of logic, facts and evidences. According to the Hon Supreme Court order, the then Labour Minister replied in the Parliament on 23.3.2017, stating that those who remitted the contibution to EPF on full salary, above statutory ceiling, now they would get pension even if they did not give the option before 2006.

After getting the approval as per all the rules of the Government, on 23.03.2017, the EPFO also issued an order for higher pension on actual salary but later on,an interim advisory was issued by the EPFO on 31.05.2017 depriving pensioners of the Exempted Establishment from this facility. Thereby the EPFO forced the old pensioners to knock the doors of the court again.

Now, after four years breaking all the boundries the EPFO issued a letter on dated 20.03.2021 negated his own circular dated 23.03.2017 (which states implementation of the Supreme Court order to provide higher pension on actual salary). Now this issue has been kept in abeyance unilaterally. This action not only insulted the Supreme Court but also insulted the Parliament.

2. The EPFO has not given correct information to the Attorney General about the pension related cases in the Supreme Court.

It is being publicized that if higher pension is given, then Rs. 15 lakh crore would be spent while in the reality (according to the information given by EPFO in the meeting of Central Board of Trustees dated 13.04.2018,) Rs. 662.9 crore per month expenditure is likely been to be incurred. Considering the increasing age of pensioners, the ability to deposit funds the pensioners are likely to opt for the minimum pension if the amount is raised to Rs. 7500+ DA as proposed by our organization. The number of pensioners accepting the option of higher pension in this case will be negligible.

3. Unrealistic issues have been presented by the Labour Secretary to the Parliamentary Committee on Labour, without checking the correct fact. The Parliamentary Committee on Labour has also not considered the fact / written proposals submitted on behalf of our organization. It means that only one side and that too of the EPFO has been taken in account by the Parliamentary Committee on Labour.

During the years 2017 to 23.09.2020 , about 1,64,003 pensioners passed away awaiting justice and many more who are in the last stage of their lives. This can definitely be said to be the culmination of the dogma and unfortunate functioning of the EPFO.

There is intense rage towards EPFO among pensioners for the above reasons.

Programme to handover the memorandum in the name of the Hon Prime Minister expressing all the truths, facts and feelings of pensioners through all the country-wide offices of the EPFO is being carried out on 06.04.2021.

This country-wide protest will be carried out by burning a Copy of the EPFO abeyance order dated 20.3.2021.

The protest will be carried out by following all the Government/Administration guide lines regarding CORONA and other issues

A memorandum to the Hon Prime Minister will also be submitted through concerned EPFO offices.

Yours faithfully,

Commander Ashok Raut,

National President

Good News for EPS 95 Pensioers: Standing Committee on Labour Recomend EPS 95 Pension Hike Rs. 3000 to 9000 Per Month, See COmplete Report

The Committee note that the Employees’ Provident Fund Organisation (EPFO) under the ambit of Employees’ Provident Fund (EPF) and Miscellaneous Provisions Act, 1952 seeks to provide for the institution of Provident Funds, Pension Funds and Deposit Linked Insurance Fund for Employees in Factories and other Establishments with the Ministry of Labour and Employment contributing 1.16% Government share towards Employee Pension Scheme, 1995. The Committee find that as on 10.02.2021, the total number of Registered Establishments stand at 15,52,186 (3477 Exempted and 15,48,709 Un-exempted); total members stand at 25,61,78,223 (1,38,04,614 Exempted and 15,48,709 Unexempted); contributing members under EPS and EPF stand at 5,71,86,202 (43,06,239 Exempted and 5,28,79,963 Un-exempted) and contributory members under EPS stand at 5,61,02,868 (43,13,835 Exempted and 5,17,89,033 Unexempted).

Keeping in view the large task for the EPFO as exuded by the above data, the Committee are happy to find that EPFO’s work has been considerably eased with 99% of EPFO collections made through internet banking mode, thereby making the system safer, seamless, secure, more effective and also in line with the Digital India Initiative. Also, EPFO’s multiple banking system facility through 13 banks has contributed to increasing flexibility and convenience bringing about positive impact on the collection and disbursals of dues in EPFO.

The Committee appreciate this laudable achievement of the EPFO and trust that systemic improvements and requisite value additions are made from time to time. The Committee would like to be apprised of the developments in this regard. 19. The Committee, however, note with concern that there is a sharp increase in grievances pending at the beginning of the year 2020-21 (as on 31.12.2021) with percentage disposal of the grievances also being the lowest at 96.82% in the year 2020-21 as compared to 99.19% and 97.78% for the years 2018-19 and 2019-20. The Committee observe that proactive measures need to be taken up speedily by the Ministry to bring down the number of unsettled grievances which stood at 30411 till the end of 2020.

The Committee are of the considered opinion that the Government should specifically look into the grievances pertaining to employers failure to deposit PF contribution deducted from the wages of the employee in the PF Accounts and simultaneously defaulting on their own contribution as well. A conscious decision leading to payment to workers who are yet to receive the statutory benefits of PF and ESI since long due to default of the employees needs to be urgently taken up for redressal.

With specific reference to EPS 95, the Committee note that the minimum pension which was announced in 2014 and continues to be applicable till date is grossly inadequate. Even this meager amount of Rs.1,000/- is reportedly not being given to many pensioners owing to various reasons and pension amounts as low as Rs.460/- are being disbursed. Therefore, demands and representations have been made for raising the monthly pension to a minimum of Rs.3,000/- or even a better amount ranging upto Rs.9,000/- per month.

A major problem with EPS 95, as brought to the notice of the Committee is that there is no link between an employees saving/contribution per se and the actual pension amount as all contributions are pooled together in one account and the pension amount disbursed on the basis of the last salary drawn by the employee. Also, reportedly, no limits exist either on the amount of withdrawals or the time frame for making withdrawals, and yet the account holder continues to be eligible for pension. EPS 95, being a ‘Defined Benefit’ scheme which guarantees a minimum pension has inherent limitations, which, as per the Ministry would be a burden on the exchequer unless appropriate changes are made in the administration of the scheme.

An increase in the pension amount to Rs.3,000/- would, as pointed out, entail an increased expenditure of Rs.15,000 crore thereby taking the total impact on the exchequer to Rs.25,000 crore. The Committee in this regard, desire that earnest efforts be made for addressing the drawbacks or limitations of the scheme, and at the same time ensure that the worker’s interest are protected by way of ensuring a reasonable monthly pension of at least Rs.3,000/- under EPS 95.The Committee would like to be apprised of the developments in this regard.

EPS 95 Higher Pension : लाखों EPS 95 पेंशनर्स के लिए जरूरी खबर, पेंशन पर आज आ सकता है सुप्रीम कोर्ट का फैसला

NEXT EPS 95 HIGHER PENSION CASES HEARING
