जैसा की हम सभी जानते है की, लोकसभा का सत्र शुरू हो गया है। लोकसभा के इस सत्र में 19 सितंबर, 2020 को आतंरिक प्रश्न संख्या 1342 तहत कर्मचारी पेंशन योजना 1995 के पेंशनधारकों केरला हाय कोर्ट के फैसले को लागु किये जाने और उच्चतम न्यायलम में लंबित मामले के सन्दर्भ में जो सवाल मा. एडवोकेट ए. एम. आरिफ और श्री. एन. के. प्रेमचन्द्रन जी द्वारा पूछे गए थे। इन सवालों के जवाब में श्रम और रोजगार राज्य मंत्री (स्वतंत्र प्रभार) श्री संतोष कुमार गंगवार जी द्वारा जो जवाब लोकसभा में दिए गए है उसी के बारे में पूरी जानकारी यहाँ पर दी गई है। इस जानकारी को ज्यादा से ज्यादा EPS 1995 पेंशनधारकों के साथ इस पोस्ट को शेयर करके पहुचाये।

क्या मा श्रम और रोजगार भंत्री यह बताने की कृपा करेंगे की:

(क) क्या EPF पेंशन की दरों को बढाने के मुद्दे पर माननीय उच्चतम न्यायलय के समक्ष लंबित किसी मामले की सर्कार को जानकारी है और यदि हा तो तत्संबधी ब्यौरा क्या है;

(ख) यदि हां, तो उक्त मामले के तीव्र निपटान हेतु सरकार द्वारा क्या कदम उठाये गए है;

(ग) क्या सरकार का वेतन पर आधारित उच्च पेंशन सबंधी विकल्प  संबध में केरल उच्च न्यायलय के आदेश को लागू करने का विचार है और यदि हा तो तत्संबधी ब्यौरा क्या है;


(घ) क्या सरकार ने केरल उच्च न्यायलय के आदेश को लागू करने पर उच्चतम न्यायलय में स्थगन प्राप्त कर  लिया है और यदि हा तो तत्संबधी ब्यौरा क्या है ;

(ङ)क्या कर्मचारी भविष्य निधि संगठन (EPFO) ने इस संबध में केरल उच्च न्यायलय के आदेश को अधीनस्थ कार्यालयों में लागु करने के निर्देश जारी किये हो और यदि हा, तो इसके क्या कारन है ; और यदि नहीं, तो केरल उच्च न्यायलय के आदेश को लागू नहीं करने क्या कारन है; और 

(च) क्या EPFO केरल उच्च न्यायलय के आदेश से बाध्य है और यदि हां, तो इसे लागू करने में विलंब के क्या कारण हैं और यदि नहीं तो इसके क्या कारन है?

(क): पूरी मजदूरी पर पेंशन की स्वीकृति  मामले पर क्रमशः यूनियन ऑफ़ इंडिया और कर्मचारी भविष्य निधि संगठन द्वारा विशिष्ठ अवकाश याचिका (एसएलपी) (सिविल) संख्या 16721-16722/2019 और समीक्षा याचिका (सिविल) संख्या 1430-1431/2019 प्रस्तुत कय दी गई है। माननीय उच्चतम न्यायलय ने दिनांक 12. 07. 2019 के आदेश के मध्यम से खुले न्यायलय में उल्लिखित एसएलपी और समीक्षा याचिका की सूचि बनाने  निर्णय लिया हैं। 

इसके अतिरिक्त, रीट याचिका (के) संख्या 233/2018 (एम. चोकलिंगम बनाम यूनियन ऑफ़ इंडिया) में दिनांक 06.02.2020 के आदेश के तहत माननीम न्यायालय छूट प्राप्त प्रतिष्ठानों के कर्मचारियों द्वारा रिट याचिकाओं को एसएलपी और समीक्षा याचिका साथ सुचिबद्ध करने का निर्देश है। 


(ख) से (च): यह मामला विचारधीन है। जैसा की, इस मामले में आगे की कार्ववाई पूर्वोक्त मामले में माननीय उच्चतम न्यायलय के निर्णय पर हुई है।

केरल के सांसद (CPM) श्री. एलमाराम करीमजी ने केरल उच्च न्यायालय द्वारा दिए गए फैसले को लागू करने के लिए 18 सितंबर 2020 को राज्यसभा में EPS 95 पेंशनधारकों का उच्चतर पेंशन का मुद्दा उठाया, जिसे सर्वोच्च न्यायालय ने 1 अप्रेल 2019 को बरकरार रखा था। सभी पेंशनरों की ओर से उन्हें बहुत-बहुत धन्यवाद। यह जानकारी EPS 1995 पेंशनधारकों के सांझा की जा रही है।  कृपया इसे ज्यादा से ज्यादा EPS 1995 पेंशनधारकों तक इस पोस्ट को शेयर करके पहुचाये। 


श्री. एलमाराम करीमजी द्वारा राज्य सभा में सभी EPS 95 पेंशनधारकों को केरला उच्च न्यायालय के आदेशानुसार उच्चतम वतम पर पेंशन का भुगतान करने का सरकार को इस संबंध में आवश्यक कार्रवाई करने और के केरल उच्च न्यायालय द्वारा दिए गए फैसले को लागू करने का आग्रह किया है।

राज्य सभा में केरल के सांसद श्री. एलमाराम करीमजी कहा गया अध्यक्ष महोदय, भविष्य निधि पेंशन योजना, 1995 के तहत पेंशन के पुनरीक्षण की लंबे समय से मांग चल रही है। देश में लगभग 65 लाख पेंशनभोगी हैं जो इस ज्वलंत मुद्दे को उठा रहे हैं।


उन्होंने आधुनिक भारत की उन्नति में एक प्रमुख भूमिका निभाई है। ईपीएस, 1995 की शुरुआत के समय, ट्रेड यूनियनों और पेंशनभोगियों ने इस योजना का विरोध किया था क्योंकि उन्हें उनके सेवा कार्यकाल के दौरान श्रमिकों द्वारा दिए गए योगदान की तुलना में बहुत कम लाभ दिए जा रहे थे।


उनके तर्क को केरल उच्च न्यायालय ने पसंद किया था और इसे सर्वोच्च न्यायालय ने भी बरकरार रखा था। लेकिन, अभी तक सरकार ने सिफारिशों को लागू नहीं किया है। इसलिए, पेंशनर्स, संगठन और ट्रेड यूनियन संघर्ष की राह पर हैं। मैं सरकार से इस संबंध में आवश्यक कार्रवाई करने और कोर्ट के फैसले सम्मान कर लागू करने का आग्रह करता हूं।

Mr. Chairman, Sir, there is a long-pending demand for the revision of pension under the Provident Fund Pension Scheme, 1995. There are about 65 lakh pensioners in the country who are raising this burning issue. They have played a major role in the advancement of modern India. 


At the time of introduction of the EPS, 1995, the trade unions and the pensioners had opposed the scheme since they were being offered much less benefits, as compared to the contributions made by the workers during their service tenure. Their argument was favoured by the Kerala High Court and it was upheld by the Supreme Court too. But, so far, the Government has not implemented the recommendations. 


Therefore, the pensioners, the organizations, and the trade unions are on the path of struggle. I urge upon the Government to take necessary action in this regard and implement the verdict of the hon. court. (Ends)

Learned counsel for the applicant/petitioner has pointed out that in identical Writ Petition No. 2222 of 2018 along with connected matters, an interim order has been passed in favour of petitioners therein. This fact has been endorsed by appearing counsel.

Being so, the petitioner is also entitled for the same interim order, being similarly situated person. Therefore, in present case also, in view of the fact that the Employee’s Pension (Amendment) Scheme, 2014, notified on 22nd August, 2014, has already been quashed by a Division Bench of Kerala High Court, the respondents shall continue to pay the revised higher pension to the petitioner, subject to the condition that in case the writ petition fails, the respondents shall be entitled to recover the excess amount out of the future arrears of pension.
 
List on 6th October, 2020 along with main petition, date already fixed for service of respondents No. 2 and 3.

In response to point no 15 of your RTI, it is stated that the serving employees in Delhi, Jaipur are covered under CGHS Scheme and medical benefits are governed as per CGHS rules. Serving Employees out side the above mentioned areas and the pensioners of EPFO are covered under CS(MA) Rules and FMA @ 2000 Rs is given to them. The source of fund is the Account No 2 of EPFO.

Fixed Medical Allowance (FMA) is paid @Rs1,000 to the Central Government Pensioners but surprisingly, EPFO Staff & Pensioners are getting FIXED MONTHLY ALLOWANCE (FMA) @Rs. 2,000 per month

Fixed Medical Allowance (FMA) is paid to the EPFO Staff & Pensioners from the Administrative Charges collected from the Employers (Account no. 2 of EPFO)

निराला रंग बिहार में आयोजित कार्यक्रम के दौरान अल्प पेंशनर्स संगठन जिला इकाई के पदाधिकारियों ने सांसद संध्या राय को ज्ञापन सौंपते हुए अल्प पेंशनधारकों को पेंशन के रूप में ₹ 7500+महगाई भत्ता मंजूर किये जाने की लंबे समय से बहुप्रतीक्षित मांग को शीध्र पूरा किये जाने। 



प्रधानमंत्री नरेंद्र मोदी एवं संसद के समक्ष उक्त गंभीर मुद्दे पर चर्चा करने का आग्रह किया।ज्ञापन सोंपते समय संगठन के जिला अध्यक्ष बी.के.बौहरे ने बताया कि मथुरा सांसद श्रीमती हेमामालिनी की अगुवाई में 04 मार्च 2020 को संगठन के राष्ट्रीय अध्यक्ष श्री अशोक राउत व अन्य पदाधिकारियों की प्रधानमंत्री श्री नरेन्द्र मोदी से इस गंभीर बिषय पर सार्थक चर्चा हो चुकी है, बावजूद इसके पेंशन बृद्धि के निर्णय में हो रही देरी को देखते हुये पुनः स्मरण वास्ते देश के सभी सांसदों को ज्ञापन प्रेषित किया जा रहा है।

EPS 95 पेंशनधारकों की मांगे 

  • ईपीएस 95 पेंशनधारकों की रु .7500 / – की न्यूनतम पेंशन का वृद्धि कर DA के साथ जोड़ा जाय। 
  • उच्च वेतन पर उच्चतर पेंशन की अनुमति देने के लिए माननीय न्यायालय के 04.10.2016 आदेश का सम्मान किया जाये, जिसपर श्रम मंत्रालयने 23 मार्च, 2017 को मानद के आधार पर मंजूरी दी गई, लेकिन कुछ ईपीएफओ अधिकारियों द्वारा 31.05.2017 को एक आदेश जारी करके सुप्रीम कोर्ट और श्रम मंत्रालय के आदेश को रोक दिया गया जिसे लागु किया जाये।
  • EPS95 पेंशनभोगी और उनके पति / पत्नी को चिकित्सा सुविधाओं का लाभ दिया जाये।
    सेवानिवृत्त कर्मचारी जो इस ईपीएस 95 योजना में पूर्व में नहीं जोड़े गए थे, उन्हें प्रवेश दिया जाएगा। अन्यथा वरिष्ठ नागरिक योजनाओं के साथ मानवीय आधार पर रु 5000 / – की न्यूनतम पेंशन प्रदान किया जाये।

As all EPS 95 Pensioners know EPS 95 Higher Pension related cases is still pending in Supreme Court of India because of this many EPS 95 Pensioners are away from getting higher pension. We also know that in April 2019 Supreme Court delivered historical decision in the favor of EPS 95 Pensioners and Maintain the KERALA HIGH COURT judgement and allowed higher pension on actual salary.

After Supreme Courts this decision EPFO filed a review petition on this Supreme Courts decision and final decision on this review petition is yet come, to resolve these EPS 95 Pensioners Higher Pension related issue one of EPS 95 Pensioner write letter to The hon'ble chief justice of Supreme court of India.


In this letter EPS 95 Pensioner Preyed to resolve EPS 95 Pensioners Higher Pension cases as early as possible and allow higher pension to pensioners.

Respected sir,

With most due respect to your kind self it is submitted that some grievances directly related to the livilihood hardship conditions of majority of EPS ( employees pension scheme ) 1995 pensioners settled across the nation suffering untold hardships are brought to your kind knowledge as hereunder for rendering the justice in review petition /SLP of EPS 1995 case. 


The EPS 1995 pensioners , having no scope of higher pension in the scheme who account in more than about 30 lakhs among the total strenth of it , get the very meagre pension that seems to be rather unbelievable by citizens unconnected to the scheme although a reality , in the range of less than Rs 1000 at minimum and about Rs 3000 at maximum without dearance allowance for the past 20 years against their total provident fund contributory service of about 25 plus to 40 years amidst the scenario of better system of pension with D A in case of central and state govt servants and multiple pensons system provided to the elected /nominated persons of legislative bodies of parliament and state assemblies for the different spells of public services. 

The EPS pensioners in question who contributed to growth of the nation in various sectors are living their life in the worsened conditions depending on others at the mercy and being unable to manage it with meagre amount of pension in the present nuclier family system of life , the wives of these pensioners do service as home servants in their present age. 

The universal formula of pension fixation on the basis of total regular service with 12 months last drawn actual wages which is ought to have been adopted has not been done in the employees pension scheme 1995.


Instead , the EPS 1995 came into effect with the formula of pensionable service that accounts only post EPS 1995 period of service ignoring the total past pre EPS 1995 service , with the ceiling of wages at Rs 5000 and then Rs 6500 and now raised to Rs 15000 for the purpose , regardless of actual wages drawn exceeding it.

In consequences of optional period of exercise for higher pension, non-coverage of exempted companies for higher pension , ceiling of wages for pensionable salary and the non-coverage period of pre-EPS 1995 for pensionable service and other impractical conditions imposed to be complied with by the pensioners for higher pension besides other changes causing discriminations among pensioners ,the litigations of EPS pensioners have come up. 


Now with the probable final hearing to take place in the coming days , the pensioners pray to seek justice by the hon'ble supreme court in the review petition and SLP filed by the EPFO ( employees provident fund organisation ) new Delhi and the hon'ble govt of India against the cases of EPS 95 pensioners kindly keeping in view of the meagre pension provided .

The purpose of writing this letter to your good self is that ; 

 Kindly these pensioners who joined service in early seventies and retired in early period of post EPS 1995 pensionable service with no scope of benefit of higher pension have to have a liveable pension that suffice it to the present cost of livilihood without much dependancy on others for their needs . The present average minimum cost of living of individual family across the nation is around Rs 10000. 

These pensioner 's basic requirement for minimum pension is Rs 7500 with it's applicable dearance allowance based on the appropriate present valuation of the recommendation report of parliamentary committee 147 given seven years back .


Given the above facts in brief, the EPS pensioners , unbenefited of the higher pension on actual wages in the present pension scheme are to be protected by ensuring socio-economic security and restoring their human rights (now deprived) providing fair pension for their qualifying service in order that they live distress-free life with human dignity.

My most humble and sincere request before the hon'ble supreme court is that while hearing the review petition filed by the EPFO against the cases of pension of EPS 95 tagged together , the justice that relates to the lakhs of organised class of workmen pensioners of India may kindly cover the minimum pension with D A to be provided to these pensioners at the level mentioned above that suffice it to present days minimum cost of life ,among other main issues .

Supreme Court Decision

FOR INFORMATION OF ALL PENSIONERS

It is surprising that a land mark judgement delivered by the Supreme Court of India on 01.07.2015, Civil Appeal no. 1123 of 2015 has gone unnoticed and except for a brief letter from Shri S R Sen Gupta to IBA, no other union has taken any steps.



The salient features of the judgement as below:

1. The bench has authoritatively ruled that Pension is a right and the payment of it does not depend upon the discretion of the Government. Pension is governed by rules and a Government Servant coming within those rules is entitled to claim pension.

2. The judgement has recognized that the revision of pension and revision of pay scales are INSEPARABLE.


3. The bench has reiterated that on revision the Basic pension cannot be less than 50% of the Basic Pension in the minimum of the Pay Band in the revised scale corresponding to the per-revised scale.

4. The government CANNOT take a plea of financial burden to deny legitimate dues of the pensioners.

5. The Government SHOULD AVOID unwarranted litigation and not to encourage any litigation for the sake of litigation.


6. When pension is upheld to be a right and NOT A BOUNTY, as a corollary to the averment that revision of pension and revision of pay scales are INSEPARABLE, up-gradation of pension is also a RIGHT AND NOT A BOUNTY.

The judgement is very clear and I wonder how no one has noticed the important aspects and why no one has taken up the matter with the Govt.

Why no one has reacted to the judgement is surprising and perplexing.

EPS 95 PENSIONERS LATESR UPDATE | EPFO Reply on Amount lying in In-operative Accounts to be used for the Pensioners of EPS’95 as stated by MoL&E

EPS 95 HIGHER PENSION | EPFO CIRCULAR |  EPS 95 MINIMUM PENSION HIKE 


As you might be aware, in reply to Question no. 240 in Lok Sabha on 18.12.2017, MoL&E had stated that the amount lying in In-operative Accounts will be used for the Pensioners of EPS’95. In RTI application EPFOG/R/E/20/10338/2 dt. 9.8.2020 in Point Nos 5 & 6, the information sought was as under:


5. How much yearly amount has been transferred in the Senior Citizens Welfare Fund during the years 2016-17 to till date in compliance of Senior Citizens Welfare Fund Rules 2016 notified by the Ministry of Finance and by EPFO vide circular dt. 13.10.2017

(b) BY PF TRUSTS of various establishments exempted by EPFO

6. In reply to unstarred question no. 240 in Lok Sabah, on 18.12.2017, MoL&E had informed that the corpus in the inoperative account as identified in the Finance Act 2015 to be transferred to Senior Citizens Welfare Fund WILL BE USED FOR THE PENSIONERS OF EPS 1995. Please intimate the year wise amount spent on the Welfare of EPS 1995 pensioners during 2016-17 to till date.


Reply received on 15.9.2020 is as under

Reply :- Point 5 and 6.

(a) No amount has beentransferred or spent on any welfare Scheme by EPFO so far.

(b) No information available for PF TRUSTS of establishments exempted by EPFO 

Since no information has been provided by EPFO in r/o Point no. 6, I am filing 1st appeal.
AMOUNT IN UNCLAIMED DEPOSIT ACCOUNTS (now called INOPERATIVE ACCOUNTS)
(The words UNCLAIMED DEPOSIT ACCOUNTS have been substituted with the words INOPERATIVE ACCOUNTS vide GSR 228(E) dt. 22.3.2007)


As per the information obtained from time to time, the closing balance of Inoperative Accounts was as under (see further details in the attachments):

  • As on 31.3.2011: Rs. 14,914 Crores
  • As on 31.3.2012: Rs. 22,636 Crores
  • As on 31.3.2013: Rs. 26,496 Crores
  • As on 31.3.2014: Rs. 27,448 Crores
  • As on 31.3.2015: Rs. 35,531 Crores
  • As on 31.3.2016: Rs. 40,865 Crores
  • As on 31.3.2017: Rs. 45,093 Crores
  • As on 31.3.2018: Rs. 54,658 Crores
  • As on 31.3.2019: Rs. 1,638 Crores (Rs. 52,920 Crores transferred from Inoperative to Operative Accounts)

Instead of spending this amount for the welfare of EPS ’95 pensioners (as stated in Lok Sabha by MoL&E on 18.12.2017), EPFO transferred a sum of Rs. 52,920 Crores in 2018-19 to the Operative account. That shows that EPFO doesn’t care even for the commitment made by MoL&E on the floor of the Lok Sabha.
