EPS 95 PENSIONERS LATESR UPDATE | EPFO Reply on Amount lying in In-operative Accounts to be used for the Pensioners of EPS’95 as stated by MoL&E

As you might be aware, in reply to Question no. 240 in Lok Sabha on 18.12.2017, MoL&E had stated that the amount lying in In-operative Accounts will be used for the Pensioners of EPS’95. In RTI application EPFOG/R/E/20/10338/2 dt. 9.8.2020 in Point Nos 5 & 6, the information sought was as under:


5. How much yearly amount has been transferred in the Senior Citizens Welfare Fund during the years 2016-17 to till date in compliance of Senior Citizens Welfare Fund Rules 2016 notified by the Ministry of Finance and by EPFO vide circular dt. 13.10.2017

6. In reply to unstarred question no. 240 in Lok Sabah, on 18.12.2017, MoL&E had informed that the corpus in the inoperative account as identified in the Finance Act 2015 to be transferred to Senior Citizens Welfare Fund WILL BE USED FOR THE PENSIONERS OF EPS 1995. Please intimate the year wise amount spent on the Welfare of EPS 1995 pensioners during 2016-17 to till date.


Reply received on 15.9.2020 is as under

Reply :- Point 5 and 6.

(a) No amount has beentransferred or spent on any welfare Scheme by EPFO so far.

(b) No information available for PF TRUSTS of establishments exempted by EPFO 

Since no information has been provided by EPFO in r/o Point no. 6, I am filing 1st appeal.
AMOUNT IN UNCLAIMED DEPOSIT ACCOUNTS (now called INOPERATIVE ACCOUNTS)
(The words UNCLAIMED DEPOSIT ACCOUNTS have been substituted with the words INOPERATIVE ACCOUNTS vide GSR 228(E) dt. 22.3.2007)


As per the information obtained from time to time, the closing balance of Inoperative Accounts was as under (see further details in the attachments):

  • As on 31.3.2011: Rs. 14,914 Crores
  • As on 31.3.2012: Rs. 22,636 Crores
  • As on 31.3.2013: Rs. 26,496 Crores
  • As on 31.3.2014: Rs. 27,448 Crores
  • As on 31.3.2015: Rs. 35,531 Crores
  • As on 31.3.2016: Rs. 40,865 Crores
  • As on 31.3.2017: Rs. 45,093 Crores
  • As on 31.3.2018: Rs. 54,658 Crores
  • As on 31.3.2019: Rs. 1,638 Crores (Rs. 52,920 Crores transferred from Inoperative to Operative Accounts)

Instead of spending this amount for the welfare of EPS ’95 pensioners (as stated in Lok Sabha by MoL&E on 18.12.2017), EPFO transferred a sum of Rs. 52,920 Crores in 2018-19 to the Operative account. That shows that EPFO doesn’t care even for the commitment made by MoL&E on the floor of the Lok Sabha.

हाल ही में सोसिअल मीडिया पर ईपीएस 95 पेंशनधारकों के हक़ में फैसला दिया गया है ऐसा एक मैसेज वायरल हो रहा है। तो आज इस आर्टिकल में इसी मेसेज के बारे में बताने जा रहे है। यह जो मेसेज सोसिअल मीडिया पर वायरल हो रहा है ओ इस तरह का है.... 


1995 के पेंशन मामले में, सुप्रीम कोर्ट ने पेंशनरों के पक्ष में फैसला सुनाया। तदनुसार, बकाया के साथ पेंशन में वृद्धि की उम्मीद है। इस निर्णय के तहत, मुख्य पी.एफ. आयुक्त ने सभी राज्य पीएफ आयुक्तों को आदेशों को लागू करने के लिए लिखा है।

जल्द ही आपको एरियर के साथ भारी पेंशन मिलेगी। उन लोगों का लाखों-करोड़ों धन्यवाद बढ़ाए गए हैं जिन्होंने इस मामले का कठोरता से और सफलतापूर्वक सुप्रीम कोर्ट तक पीछा किया है। कर्मचारी, पेंशनर, सेवानिवृत्त पेंशनर्स एसोसिएशन कृपया संदेश को अग्रेषित करें और उन लोगों / संगठनों का धन्यवाद करें जिन्होंने लड़ाई लड़ी।

भोपाल के एक समाचार पत्र के अनुसार, न्यूनतम लागू पेंशन रु. 8,500 / - अधिकतम रु. 25,000 / - वितरित किया जाएगा। 


इस मेसेज की जाँच करने के बाद मैं सभी ईपीएस 95 पेंशनधारकों को इसकी सच्चाई बताने जा रहा हु। जैसा की हम जानते है की करना महामारी की  वजह से सुप्रीम कोर्ट का कामकाज वर्चुअल माध्यम से हो रहा है और फिलहाल ईपीएस 95 पेंशनधारकों की हायर पेंशन से सम्बंधित किसी भी  याचिका का पर सुनवाई नहीं हुई है। 

ऐसे में यह जो मेसेज वायरल हो रहा है, ऐसे में सभी ईपीएस 95 पेंशनधारकों के मन भ्रम पैदा हो सकता है की सुप्रीम कोर्ट में ईपीएस 95 पेंशनधारकों से सम्बंधित याचिका पर सुनवाई हो गई है और अभी उनको बढ़ी हुई पेंशन मिलनी शुरू हो जाएगी पर ऐसा नहीं है क्यों की EPFO द्वारा जो पुनर्विचार याचिका और यूनियन ऑफ़ इण्डिया द्वारा जो SLP सुप्रीम कोर्ट में दाखिल की  उनपर मौजूदा समय में कोई भी सुनवाई नहीं हुई है। 


इस लिए सभी ईपीएस 95 पेंशनधारकों को अवगत करना चाहता हु की यह एक पुराना मेसेज है जो अभी सितंबर 2020  फैलाया जा रहा है।  अगर आपके पास भी ऐसा कोई मेसेज आता है तो कृपया उसे आगे न भेजे क्यों की यहाँ भ्रम फैला रहा है। 

सभी ईपीएस 95 पेंशनधारकों तक इस आर्टिकल को शेयर करे ताकी इस मैसेज की सच्चाई सभी को पता चल सके।  


जैसे ही ईपीएस 95 पेंशनधारकों की याचिकाओं पर सुप्रीम कोर्ट से कोई उपडेट आएगा तो उसे सभी के साथ सांझा कर दिया जाएगा।

It is informed that the Fourth Session of Seventeenth Lok Sabha and the Two Hundred and Fifty Second Session of Rajya Sabha (Monsoon Session of Parliament 2020) shall be held from 14th September 2020 (Monday) to 01st October 2020 (Friday).

The following dates have been allotted for Parliament Questions related to the Ministry of Labour & Employment:-

Dates allotted for Parliament Questions related to MoL&E in Lok Sabha: 14thc19thc24th & 29thc September 2020. 

Dates allotted for Parliament Questions related to MoL&E in Rajya Sabha: 16thc 21stc26th September & 01st October 2020.


It is requested that the required information/material for framing replies to Parliament Questions be sent through e-mail at rc.pqcell@epfindia.gov.in, in order  to  avoid  any  delay.  Further  it  is  also  advised  that  the  official  website  of EPFO may also please be visited on a daily basis for any other additional information in the matter. It shall be the responsibility of the RPFCs concerned to ensure that the replies received through E-mail are sent to PQ Cell within the prescribed time limit.


It has been experienced in the past that Parliament Questions are sometimes received at a very short notice. It is therefore requested that all concerned may ensure that the officers/staff  posted under them remain available during the above mentioned period.

This message is from Chennai based pensioner's association, Guindy, Chennai -32.

They call for an attention particularly pensioners who retired after1.9.2014.

They recently conducted a meeting on 5.9.2020 and decided to challenge the EPFO Chennai for calculating Pensionable salary on the basis of average of 60 months instead of 12 months. 


Association ask the members to pay subscription Rs210/- as well as contribution Rs 3000/- for court expenses..and they mentioned Address of the association office where the members are expected to remit their respective fees. And also mentioned contact person's Phone numbers. 

Interested Chennai based petitioners may contact them.. according to the association opinion if they succeed in their efforts a successful Petitioner may get an increase of Rs. 500 to Rs. 2000 In their pension as per their 12 months salary average. 


Why they are very eager because, In this regard a petitioner appealed in hon'ble high court of kerala and challenged the EPFO against 1.9.2014 amendments particularly Calculating pensionable salary on the basis of 60 months average instead of 12 months and got a verdict in favour of the petitioner, and court directed EPFO to complete the court directions with in 12 weeks.

Good News For Pensioners | Government Extend period for submission of Life Certificate from October 2020 till December 2020, Order Issued

केंद्र सरकार ने लाखो  पेंशनधारकों को बड़ी राहत देते हुए जीवन प्रमाणपत्र जमा करने की तिथि को 31 दिसंबर 2020  तक बढ़ा दिया है। इसके लिए Ministry of Personnel, Public Grievances & Pension Department of Pension & Pensioners’ Welfare द्वारा कार्यालय इसके तहत अब पेंशनभोगी अपना जीवन प्रमाणपत्र यानी जीवित होने का प्रमाणपत्र  1 नवंबर से 31 दिसंबर 2020 तक जमा कर सकते हैं। इसके आलावा इस साल सरकार ने 80 साल और उससे अधिक उम्र के पेंशनधारकों के लिए यह जीवन प्रमाणपत्र जमा करने की सुविधा 1 अक्टूबर से ही देने का फैसला किया है। इसका मतलब यह है कि इस उम्र के पेंशनधारक 1 अक्टूबर से 31 दिसंबर 2020 तक जीवन प्रमाणपत्र जमा कर सकते हैं। खास बात यह है की, इस अवधि के दौरान पेंशनधारकों को भुगतान होता रहेगा।


इससे पहले यह अवधि सिर्फ नवंबर की शुरुआत से आखिर तक होती थी। बैंकों से यह भी कहा गया है कि वे पेंशनभोगियों से जीवन प्रमाणपत्र हासिल करने के लिए वीडियो आधारित ग्राहक पहचान प्रक्रिया (वी-सीआइपी) के उपयोग का रास्ता तलाशें। इसके तहत पेंशनभोगी अपने मोबाइल फोन या लैपटॉप के माध्यम से वीडियो के जरिये अपने जीवित होने का सुबूत दे सकते हैं। इसके अलावा पेंशनधारक अपनी सुविधा के अनुसार बैंकों की शाखाओं में जाकर यह जीवन प्रमाणपत्र जमा कर सकते हैं।

  • सबसे पहले आप http://jeevanpramaan.gov.in/ पर जाएं।
  • इसके बाद पेंशन वाले कॉलम में अपने आधार का ई वेरिफिकेशन करें। 
  • इसके बाद ई वेरिफिकेशन का डिजिटल लाइफ सर्टिफिकेट जनरेट होगा। 
  • यह सर्टिफिकेट आपके लाइफ सर्टिफिकेट रिपॉजिटरी में स्टोर हो जाएगा। 
  • यदि आप बैंक जाकर ई वेरिफिकेशन कराते हैं तो बैंक अधिकारी आपको लाइफ सर्टिफिकेट का प्रिंट आउट साइन कर प्रदान करेगा।

Subject: - Extension of period for submission of Life Certificate from October 2020 till December 2020.

Every Central Government pensioner has to submit life certificate in the month of November for further continuation of his/her pension. It has been observed that a large number of Central Government pensioners physically visit bank branches for this purpose.

2. Earlier, as a measure to enable additional dedicated time to very senior pensioners, this department, vide its OM No. 1/20/2018-P&PW(E), dated 18.07.2019, allowed the pensioners in the age group of 80 years and above, to submit Life Certificate from 1st October onward instead of 1st November, every year.

3. In view of the ongoing Covid-19 pandemic and keeping in view of the vulnerability of elderly population to Corona Virus, it has now been decided to extend the existing timeline for submission of Life Certificate. This year, all Central Government pensioners may submit Life Certificate from 1st November, 2020 onward, till 31st December 2020. However, the pensioners in the age group of 80 years and above, can submit Life Certificate from 1st October, 2020 onwards, to 31st December, 2020. During this extended period, the pension will be continued to be paid by the Pension Disbursing Authorities (PDAs) uninterrupted.


4. Further, in the line of RBI notification no. RBI/2019-20/138, dated January 9, 2020, which permits Video based Customer Identification Process (V-CIP) as a consent based alternate method of establishing the customer’s identity, PDAs may also explore the said methodology for obtaining a Life Certificate from the pensioner, to the extent permitted by RBI guidelines, in order to avoid rush at the branches. 

5. The above measures are expected to avoid rush at branches and maintain social distancing, while obtaining Life Certificates from the elderly this year. PDAs shall also ensure proper arrangements and social distancing measures at the branches and prevent overcrowding.

6. All Pension Disbursing Authorities are requested to take note of this OM for compliance and give wide publicity to the same amongst the pensioners.

It is objected by counsel for the respondent No. 1 to 3 that respondent No. 4 to 6 had been advised to send revised returns 6A/3AR but the same has not been sent.



Keeping in view the judgment passed in the 2018 (14) SCC 809 case which had been made applicable to others and keeping in view the law laid down in this Court in the case of Vinod Kumar Sharma & Ors. Vs. Chairman Central Board of Trust and Ors.: 2019 (1) WLC (Raj.) 559, it is directed that respondent No. 4 to 6, shall send the revised returns of the petitioner at the earliest but not later than one week from today to respondents No. 1 to 3. Thereafter, respondent No. 1 to 3, shall proceed to release the revised pension of the petitioner. This is more so as the documents which have been shown to this Court reveal that option had already been submitted by petitioner for pension.



The said process shall be completed within a period of three weeks from today.
List this case again on 5th October, 2020.
