EPS 95 Pensioners Higheer Pension Order: Difference in UOI vs Sunil Kumar's Stay Application dt 16-01-2021 in Supreme Court

EPS 95 HIGHER PENSION ORDER | EPS 95 HIGHER PENSION LIST

Some EPS 95 Pensioners observed difference in data presented by Mr. Samir Kumar Das, Under Secretary in Ministry of Labour & Employment, Government of India in STAY APPLICATION in SLP (Civil) No. 16721-16722 of 2019.
On page no. 6 of application:


Retrospective contribution received from an areas of pension payable to the employee, for impugned Judgement.

Retrospective contribution at 8.33 percent on actual wage with interest upto 12/2019: Rs. 3895719

Areas of pension paid from (5/2017 to 12/2019): Rs. 4196154

11 this is the cause of the net actuarial deficit of Rupees 1528519.30 7 crores mensioned earlier. The fact that the present value of EPS 95 is only 3.77 lakhs crores, shows that implementation of the judgement would result in complete collapse of employee pension scheme in foreseeable future. It must be mentioned here that till date, EPFO has been forced to pay a total amount of rupees 12047.37 crores in compliance of the impugned of judgement in satisfaction of 15268 claims. As against this total contribution received only rupees 364.60 crores.


“It must be mentioned here that till date, EPFO has been forced to pay a total amount of Rs. 1,204.37 crores in compliance of the impugned judgment in satisfaction of 15,628 claims. As against the total contribution received is only Rs. 364.40 crores.”

Higher wages pension as on 17-01-2020

Total No. of Pensioners: 24,672

Amount of contribution and interest remitted by pensioners: Rs. 7,23,63,02,991 (723.63 crores)

Pension Arrears paid to pensioners: Rs. 7,46,09,48,080 (746.09 crores)

1. Copy of the file no. Pension-I/12/33/EPS Amendment/96/Vol.II (Noting pages as well as correspondence pages) for the period 1.1.2019 onwards till the date.


2. Copy of the file no. Pension-I/12/33/EPS Amendment/96/Vol.II/Pt. (Noting pages as well as correspondence pages) for the period 1.1.2019 onwards till the date.

3. Detail of cases of pension revision settled by all the Regional Offices (Zone wise) in compliance of EPFO HQ directive dt. 23.3.2017 up-to-date of supply of information to me. Such information is being sent to HQ regularly by all the Zones every week on Fridays.


4. Soft copy of the up-to-date compiled data (Excel format) regarding pension revision by all the Regional Offices (Zone wise) in compliance of EPFO HQ directive dt. 23.3.2017 (received by HQ in excel format from all the Zones) based on which the consolidated information as at Sr. No. 3 above is prepared. Latest available Soft Copy of the consolidated information (in the same form i.e. EXCEL format as available).

5. Special Audit of pension cases revised on higher wages had been got conducted by the PENSION DIVISION in r/o Regional Offices Chandigarh, Thiruvananthapuram and Puducherry vide U.O. note no. Pension-I/12/33/EPS Amendment/96/Vol.II/Pt dated 2.8.2019 from Mr. K.L.Taneja, ACC HQ, Pension to Ms. Neelam Sanghi, ACC HQ, Audit. Copies of these Special Audit Reports had also been sought by the PENSION DIVISION (refer sr no. 4 of the said office note). Please provide me copies of all the three special audit reports along with all enclosures as received by PENSION DIVISION from the Audit Wing along with a copy of the forwarding letter by which the said 3 reports were received by PENSION DIVISION.
