Good News for EPS 95 Pensioers: Standing Committee on Labour Recomend EPS 95 Pension Hike Rs. 3000 to 9000 Per Month, See COmplete Report


The Committee note that the Employees’ Provident Fund Organisation (EPFO) under the ambit of Employees’ Provident Fund (EPF) and Miscellaneous Provisions Act, 1952 seeks to provide for the institution of Provident Funds, Pension Funds and Deposit Linked Insurance Fund for Employees in Factories and other Establishments with the Ministry of Labour and Employment contributing 1.16% Government share towards Employee Pension Scheme, 1995. The Committee find that as on 10.02.2021, the total number of Registered Establishments stand at 15,52,186 (3477 Exempted and 15,48,709 Un-exempted); total members stand at 25,61,78,223 (1,38,04,614 Exempted and 15,48,709 Unexempted); contributing members under EPS and EPF stand at 5,71,86,202 (43,06,239 Exempted and 5,28,79,963 Un-exempted) and contributory members under EPS stand at 5,61,02,868 (43,13,835 Exempted and 5,17,89,033 Unexempted).


Keeping in view the large task for the EPFO as exuded by the above data, the Committee are happy to find that EPFO’s work has been considerably eased with 99% of EPFO collections made through internet banking mode, thereby making the system safer, seamless, secure, more effective and also in line with the Digital India Initiative. Also, EPFO’s multiple banking system facility through 13 banks has contributed to increasing flexibility and convenience bringing about positive impact on the collection and disbursals of dues in EPFO.


The Committee appreciate this laudable achievement of the EPFO and trust that systemic improvements and requisite value additions are made from time to time. The Committee would like to be apprised of the developments in this regard. 19. The Committee, however, note with concern that there is a sharp increase in grievances pending at the beginning of the year 2020-21 (as on 31.12.2021) with percentage disposal of the grievances also being the lowest at 96.82% in the year 2020-21 as compared to 99.19% and 97.78% for the years 2018-19 and 2019-20. The Committee observe that proactive measures need to be taken up speedily by the Ministry to bring down the number of unsettled grievances which stood at 30411 till the end of 2020.


The Committee are of the considered opinion that the Government should specifically look into the grievances pertaining to employers failure to deposit PF contribution deducted from the wages of the employee in the PF Accounts and simultaneously defaulting on their own contribution as well. A conscious decision leading to payment to workers who are yet to receive the statutory benefits of PF and ESI since long due to default of the employees needs to be urgently taken up for redressal.

With specific reference to EPS 95, the Committee note that the minimum pension which was announced in 2014 and continues to be applicable till date is grossly inadequate. Even this meager amount of Rs.1,000/- is reportedly not being given to many pensioners owing to various reasons and pension amounts as low as Rs.460/- are being disbursed. Therefore, demands and representations have been made for raising the monthly pension to a minimum of Rs.3,000/- or even a better amount ranging upto Rs.9,000/- per month.


A major problem with EPS 95, as brought to the notice of the Committee is that there is no link between an employees saving/contribution per se and the actual pension amount as all contributions are pooled together in one account and the pension amount disbursed on the basis of the last salary drawn by the employee. Also, reportedly, no limits exist either on the amount of withdrawals or the time frame for making withdrawals, and yet the account holder continues to be eligible for pension. EPS 95, being a ‘Defined Benefit’ scheme which guarantees a minimum pension has inherent limitations, which, as per the Ministry would be a burden on the exchequer unless appropriate changes are made in the administration of the scheme.


An increase in the pension amount to Rs.3,000/- would, as pointed out, entail an increased expenditure of Rs.15,000 crore thereby taking the total impact on the exchequer to Rs.25,000 crore. The Committee in this regard, desire that earnest efforts be made for addressing the drawbacks or limitations of the scheme, and at the same time ensure that the worker’s interest are protected by way of ensuring a reasonable monthly pension of at least Rs.3,000/- under EPS 95.The Committee would like to be apprised of the developments in this regard.

SUPREME COURT – 59 EPS’95 matters - 24.03.2021

As per the discussions held in the Court on 23.03.2021, EPS’95 matters are to be heard after the completion of hearing in a part heard matter i.e. SLP No. 20417 of 2017 titled M/S Daiichi Sankyo Company Ltd vs OSKAR Investments Ltd.  When asked by the Court, the advocate Mr. Shyam Divan had also stated that his pleadings were likely to be completed in the first session (till 01:00 PM) on 24.03.2021. 

But the EPS’95 cases have not been found mentioned in the Cause Lists for 24.03.2021.  So, let us see what happens after the completion of pleadings in the aforesaid case i.e.  item no. 19 (the last item of the Cause List for 24.03.2021 in r/o Court no. 3)

देश के लाखों EPS 95 पेंशनर्स के लिए यह बहुत जरूरी सूचना है। EPFO Pension को लेकर इन दिनों सुप्रीम कोर्ट में सुनवाई चल रही है। इस पर जल्‍द ही अदालत का फैसला आ सकता है। इस संबंध में ताजा खबर यह है कि सर्वोच्च न्यायालय ने केरल उच्च न्यायालय के फैसले के खिलाफ कर्मचारी भविष्य निधि संगठन (ईपीएफओ) द्वारा दायर अपील में विरोधी पक्षों को नोटिस दिया था, जिससे पूर्ण पेंशन का वितरण होता है।


इस सुनवाई में शीर्ष अदालत ने दो सप्ताह के भीतर जवाब देने की मांग की थी और मामले को 23 मार्च के लिए स्थगित कर दिया। ईपीएफओ ने मामले को स्थगित नहीं करने का अनुरोध किया था क्योंकि केरल उच्च न्यायालय के फैसले पर तुरंत रोक लगाने के लिए एक अंतरिम याचिका दायर की गई है। उन्होंने तर्क दिया था कि उच्च न्यायालय के फैसले के अनुसार पेंशन में 50 गुना की वृद्धि होगी और वे पेंशनरों के अधीक्षण के दौरान राशि की वसूली नहीं कर सकते हैं।


जनवरी में न्यायमूर्ति यू यू ललित की अध्यक्षता वाली पीठ ने केवल सर्वोच्च न्यायालय के फैसले को वापस ले लिया, जबकि उच्च न्यायालय के फैसले को रोक दिया गया था, यह अभी भी वैध है। इसके बाद, EPFO ने मामले पर तुरंत विचार करने का अनुरोध किया। न्यायमूर्ति यू यू ललित की अध्यक्षता वाली पीठ ने आश्वासन दिया कि मामले को आगे नहीं बढ़ाया जाएगा और सुनवाई 23 मार्च से दैनिक आधार पर आयोजित की जाएगी।

तो जी हा देश के लाखों EPS 95 पेंशनर्स आज का दिन काफी महत्वपूर्ण है, क्यों की आज यानि 23 मार्च से EPS 95 पेंशन से संबधित मामलों पर सुनवाई दैनिक आधार पर शुरू होगी। 23 मार्च को SLP (C) 16721 -22/2019 पर सुनवाई हो सकती है। इससे पहले WP (C) 233/2018 को सूचीबद्ध किया गया था।


यह योजना कर्मचारी भविष्य निधि संगठन (EPFO) द्वारा प्रदान की जाती है और यह सुनिश्चित करती है कि कर्मचारी 58 वर्ष की आयु प्राप्त करने के बाद पेंशन प्राप्त करें। मौजूदा, साथ ही नए ईपीएफ सदस्य, योजना का लाभ उठा सकते हैं।

सूत्रों के अनुसार, सरकार को आरएस 2,000 की न्यूनतम पेंशन को लागू करने पर 4500 करोड़ रुपये का अतिरिक्त खर्च वहन करना होगा और अगर इसे 3,000 रुपये तक बढ़ा दिया जाता है, तो सरकारी खजाने को बड़े पैमाने पर 14,595 करोड़ रुपये खर्च होंगे।

Regional Convention of National Agitation Committee as per the direction of National Leadership successfully organized in North India, Kanpur on Dtd. 21.03.2021.

Angry rage towards EPFO shown in pensioners and yet sloganeering against not accepting the main demands.  At the same time, the old pensioners showed a willingness to sacrifice to any extent in support of the demands.

Senior leaders made an appeal to be patient for some time to fulfill the assurances given by the Hon. Prime Minister directly.

EPS-95 राष्ट्रीय संघर्ष समिति क्षेत्रीय सम्मलेन कानपुर उत्तर प्रदेश में दि. 21 मार्च 2021 को श्री बाजार स्टाफ धर्मशाला ट्रस्ट, 375A, H ब्लॉक, किदवई नगर, कानपुर में संपन्न हुई।

Immediate reaction & response from pensioners it is shocking & unbelievable as same was issued on the eve of commencement of hearing of SLP on 23-3-2021.

Further it amounts to interfering & influencing on judicial proceedings to commence shortly on 23-3-2021. It may be noted that action has come after time gap of more than four years that to circular issued on 20-3-2021 which happens to be holiday.

Earlier EPFO never thought or  considered similar action in different courts. It is after thought & just deny the benefits to pensioners from SC order dated 4-10-2016 & Implementation order dated 23-3-2017.

This action of EPFO must be countered & challenged in SC, attention of CJI, SCBA must drawn for timely  suitable action. Now intention of EPFO is very much clear that it will do everything to possible to call for review earlier SC order of 4-10-2016



This is common issue & hence all AOR, Sr Advocate should have a common strategy, court / floor coordination for presenting EPS matter strongly & effectively  before three judges bench. 

It is now or never
There urgent need for United fight in SC by respective Sr advocate. We have to fight against all odds. So Let us hope & pray for best outcome.

These are my views & this issue may be shared with UR concerned AOR & Sr Advocates for immediate further action.

Good News For EPS 95 Pensioners: Hon. MP Smt.Hema Malini Ji Gave Confidence to EPS 95 Pensioners Regarding EPS 95 Pension Hike


National Vice President of NAC Shri Asharam Sharma meets MP, Smt. Hema Malini Ji.

Under the guidance of Hon. NAC Chief Commander Ashok Raut ji, National Vice President Shri Asharam Sharma met MP, Smt. Hema Malini ji in Delhi on 17.3.2021 and discussed in detail the problems of pension holders.


In this context, Hema Malini Ji said that she is putting all the possible efforts and supporting all the demands of the pensioners. She is in communication with the concerned dignitaries, also she is with the pensioners and committed to fulfilling the demands of the pensioners

Also. Hon. Smt. Hema Ji advised the organization to have a little more patience.


It may be known that on 4 March 2020, the Hon. Prime Minister himself assured NAC representatives in the presence of Hema ji and guidelines were also issued to the Minister concerned, since then these old pension holders are hopeful and looking for justice.


It should also be known that all the agitations were withdrawn by the NAC organization, but the, Chain Hunger Agitation continues in front of the District Magistrate's Office at Buldhana (Maharashtra), the headquarters of the NAC and today is the 817th day of the Agitation.
