गजेट नोटिफिकेशन जारी करने हेतु मा. श्रममंत्री जी से किया निवेदन। पत्र की प्रतीलीपी मा. प्रधानमंत्री जी, मा. वित्तमंत्री जी, मा. राज्य मंत्री, प्रधानमंत्री कार्यालय, मा. श्रीमती हेमा मालिनी जी, संसद सदस्य, मथुरा सभी सन्माननीय CBT सदस्य व मा. सी पी एफ सी को भेजी गई। 

पत्र में मा. प्रधानमंत्री के साथ मा. श्रीमती हेमा मालिनी जी की अगुआई में NAC प्रतिनिधियों के साथ हुई मीटिंग का उल्लेख किया गया है। पत्र में यह भी लिखा गया है कि सरकारी यंत्रणा के द्वारा हमें विश्वसनीय सूत्रों से संकेत मिल रहे हैं कि पेंशन धारकों की मांगों को आगामी संसद /बजेट सत्र में स्वीकार किया जाएगा लेकिन EPS 95 वृद्ध पेंशन धारकों मृत्यु दर को देखते हुए इस विषय पर राजपत्र अधिसूचना को प्राथमिकता पर जारी किया जाए। यह भी निवेदन किया जाता है कि इस कार्रवाई से हमारे बुजुर्ग नागरिकों को उनकी मृत्यु के पहले असीम संतुष्टि मिलेगीे।

Hon. NAC Chief Commander Ashok Raut wrote again to the Labour Minister to issue a Gazette Notification regarding the EPS 95 pensioners demands. The letter is copied to the Hons. Prime Minister, Finance Minister, Minister of State, Prime Minister's Office, Smt Hema Malini ji, MP, Mathura, All Hon. CBT Members and Hon. CPFC.

Ref. of meeting with the Hon PM organized with NAC representatives along with graceful presence of Hon Smt Hema Malini ji is mentioned in this Letter.

It is written in the letter that through government machinery the NAC is getting indications from reliable sources that the demands of pension holders will be accepted in the upcoming Parliament / Budget session. 

However, In view of the mortality rate of EPS 95 aged pensioners , the Gazette notification on this subject should be issued on priority. It is also requested that by this action our elderly citizens will get immense satisfaction before their death which any way is inevitable.

EPS 95 PENSIONER NEWS | EPS 95 PENSIONERS MEETING ON MINIMUM PENSION HIKE 7500, DISCUSSION ON RECENT TALK WITH MP HEMA MALINIJI

There are continuous efforts by the National Conflict Committee to get the demands of 65 lakh EPS 95 pensioners of the country. With the addition of dearness allowance including minimum pension 7500 to EPS 95 pensioners by the National Conflict Committee, medical facility, Ma. As per the order of the Supreme Court, the demand for payment of pension at the highest salary is being sought. On October 9, 2020, a leader of Sugar Mills, Vellore, Tamil Nadu spoke to Mr. Smt. Hema Malini ji, MP, Mathura, to fulfill these demands at the earliest.

The result of the telephonic call will be informed by organizing an online meeting of all EPS 95 pensioners in a video call on Sunday at 10.10 am. This video meeting will be organized on JioMeet. As per the information obtained from time to time, the closing balance of Inoperative Accounts with EPFO was as under:

• As on 31.3.2011: Rs. 14,914 Crores (as per RTI)

Different information sought from EPFO regarding the amount lying in and transferred from IN-OPERATIVE ACCOUNTS vide RTI - EPFOG/R/E/20/10338 dt. 9.8.2020 wherein the Information in Point No. 6&7 had been sought as under:

In reply to unstarred question no. 240 in Lok Sabah, on 18.12.2017, MoL&E had informed that the corpus in the inoperative account as identified in the Finance Act 2015 to be transferred to Senior Citizens Welfare Fund WILL BE USED FOR THE PENSIONERS OF EPS 1995. Please intimate the year wise amount spent on the Welfare of EPS 1995 pensioners during 2016-17 to till date.

 

7. Amount, if any, transferred from inoperative accounts to some other head/account, please provide year wise details of such transfer Reply Point No. 7 (RTI - EPFOG/R/E/20/10338/3 dt. 9.8.2020-Received on 25.8.2020): A sum of Rs. 52919,79,90,114.45 has been transferred from in-operative account to EPF Contribution Fund – Members’ operative account during the year 2018-19, due to amendment in definition of in-operative accounts w.e.f. 11.11.2016. Apart from this, an amount of Rs. 1,881.5 crores was released from the inoperative account in 2018-19 towards the payment of claims to those holders of inoperative accounts who came forward to claim their provident fund. ईपीएफओ से अलग जानकारी मांगी थी जिसमें पड़ी राशि और आरटीआई - ईपीएफओ द्वारा इन-ऑपरेटिव खातों से स्थानांतरित की गई थी - ईपीएफओजी / आर / ई / 20/10338 दिनांक 9.8.2020 पॉइंट नंबर में सूचना है नीचे के रूप में 6&7 की मांग की गई थी:

मा. कमांडर अशोक राउतजी ने सभी को उनकी होनोरेबला मिनिस्टर फॉर लेबर वेलफेयर और मिनिस्टर फॉर स्टेट फॉर पेंशन विभाग के बैठक के बड़े जानकारी दी। मा. कमांडर अशोक राउतजी द्वारा आगे बताया गया की लगबघ 90% तक पेंशन बढ़ोतरी का काम पूरा होने को बस कुछ फोर्मलिटिस ही बाकि है। इसके अतिरिक्त पेंशन से संबधित और भी मामलों के बारे अवगत कराया गया। हाला की मा. कमांडर अशोक राउतजी द्वारा  कुछ जानकारिया सार्वजनिक नहीं किया गया है जिसे वक्त आने पर बताया जायेगा। साथ मा. कमांडर अशोक राउतजी द्वारा सभी सदस्यो से कहा  उन्हें नवम्बर महीने तक कोई आंदोलन न किया जाये क्यों  इसी समय कुछ अच्छी खबर आने की उम्मीद जताई जा।

देश के 65 लाख EPS 95 पेन्शनर्स की मांगे मंजूर करवाने के लिए राष्ट्रीय संघर्ष समिति द्वारा लगातार प्रयास किये जा रहे है। राष्ट्रीय संघर्ष समिति द्वारा EPS 95 पेन्शनर्स को न्यनतम पेंशन 7500 समेत महंगाई भत्ते जोड़े जाने के साथ, चिकित्सा सुविधा, मा. उच्चतम न्यायलय के आदेशानुसार उच्च्चतम वेतन पर पेंशन के भुगतान की मांगे की जा रही है। इसी मांगो को जल्द से जल्द पूरा कराने के लिए राष्ट्रिय संघर्ष समिति NAC बैंगलोर की ओर से EPS 95 पेंशनर्स की मांगो को मंजूर करवाने के लिए श्री नागराज जी, कर्नाटक राज्य उपाध्यक्ष, ने सांसद सदस्य से गुजारिश की थी। जिसके बाद संसद सदस्य श्री पी.सी. मोहन ने EPS 95 पेंशनरों की मांगों के संबंध में कार्मिक, लोक शिकायत और पेंशन राज्य मंत्री को पेंशनधारको की मांगो पर ध्यानाकर्षण के लिए पत्र लिखा है। आज के इस अपडेट में इसी के बारे में जानकारी लेने वाले है। 

मंगलवार दिनांक 06 अक्टूबर 2020 को बैंगलोर के सांसद सदस्य श्री पी.सी. मोहनजी ने EPS 95 पेंशनधारको की मांगो के सम्बद्ध में एक पत्र कार्मिक लोक शिकायत और पेंशन राज्य मंत्री श्री जितेंद्र सिंह जी को लिखा है। इस पत्र में EPS 955 पेंशनधारको की मांगो को मंजरू करने की गुजारिश और EPS 95 पेंशनधारको को सहयोग देने की अपील की गई है। 

इस पत्र में सांसद सदस्य श्री पी.सी. मोहनजी ने कहा की EPS 95 पेंशन के विषय के संबंध में मुझे एक प्रतिनिधित्व दिया  गया है, जिस पर आपको ध्यान देने की आवश्यकता है। संगठन द्वारा उठाए गए मुद्दे वास्तव में EPS 95 पेंशनरों से संबधित है और मैं इस मामले को सुलझाने के लिए आपकी ओर से समर्थन चाहता हूं क्योंकि यह मामला वरिष्ठ नागरिकों को दुखी कर रहा है।

मुझे यह समझने के लिए भी दिया गया था कि कुछ पात्र लाभार्थियों को उपरोक्त योजना के दायरे से बाहर रखा गया है और मैं आपसे आग्रह करता हूं कि आप उस पर ध्यान दें। इससे उन हजारों वरिष्ठ नागरिकों को मदद मिलेगी, जिन्होंने देश के लिए काम किया है, लेकिन अब वे अपनी आवाज नहीं उठा पा रहे हैं। मैंने आपकी समझ के लिए याचिका को संलग्न किया है।

Supreme Court Latest Judgement: SC Said Is SLP against an order rejecting the review petition maintainable when main judgment is not under challenge

The 3-judge bench Ashok Bhushan, R. Subhash Reddy and MR Shah has reiterated that when the main judgment of the High Court has not been challenged, no relief can be granted by this Court in the special leave petition filed against order rejecting review application to review the main judgment of the High Court.

The Court was hearing a case relating to suspension of an employee of a cooperative bank after conduct of disciplinary authority.

• The Cooperative Tribunal later imposed a punishment of compulsory retirement on the petitioner.
• This order was challenged before the High Court but the same was dismissed.
• Hence, the petitioner filed an SLP before the Supreme Court which was also dismissed in 2015.
• A review petition was filed which was also dismissed in 2016.
• A curative petition was also dismissed in 2016.
• Then the review petition was again filed which was dismissed by the High Court vide its judgment dated 06.02.2020. Hence, this SLP.

The Court noticed that in Bussa Overseas and Properties Private Limited v. Union of India, (2016) 4 SCC 696 has held that principle of not entertaining special leave petition against an order rejecting the review petition when main judgment is not under challenge has become a precedential principle.

Applying the same principle to the present case, the Court said that against the main judgment the SLP having been dismissed earlier the same having become final between the parties cannot be allowed to be affected at the instance of petitioner.

Supreme Court Said:

The rationale for not entertaining a special leave petition challenging the order of High Court rejecting the review petition when main order in the writ petition is not challenged can be easily comprehended. Against the main judgment the SLP having been dismissed earlier the same having become final between the parties cannot be allowed to be affected at the instance of petitioner.

When the main judgment of the High Court cannot be effected in any manner, no relief can be granted by this Court in the special leave petition filed against order rejecting review application to review the main judgment of the High Court. This Court does not entertain a special leave petition in which no relief can be granted. It is due to this reason that this Court in Bussa Overseas and Properties Private Limited and Anr. (supra) has held that principle of not entertaining special leave petition against an order rejecting the review petition when main judgment is not under challenge has become a precedential principle. We reiterate the above precedential principle in this case again."

Whenever we want to request the Prime Minister of the country, I don't know why some people feel that we are all Congressmen or opposition who want to oppose their every good and bad things. We are here talking about the law of the country which has been completed after the party or the opposition has been passed by the MP and after the President's seal stamped, which is keeping us deprived. We are talking about the supreme court of the country whose orders are being shaken in compliance with.

Not only that, we are also trying to talk about the welfare of the Modi's government, showing great generosity in 2014, decided to give the pensioners a minimum of Rs. 1000, now their To show the same generosity a little further, do you want to give the status of opposition to the common pensioners like their Congressmen or opposition.

Here's the point that EPS95 is a lawless, govt. pensioners, which the Supreme Court has also clarified in its 4/10/2016 order that the mistakes in implementing the scheme were made. The government has done that it was illegal and all pensioners should be given their rights as per their rules, the government also issued an order of compliance in March 2017, on which the supreme court has not been given but the government's same. The government mulajim has been banned since 31/5/2017, as if they have higher rights than the Prime Minister and the Supreme Court.

This is the only thing in which Modi ji's silence should not be taken out such a way that the pensioners are being injustice and Modi ji is silent acceptance on all this. Who is forcing us to take a round of the court, does anyone need to explain this. How our post is helpful in fighting two parties, we are not talking about any Modi supporter and other Congress supporter group. There is no political platform for pensioners which can be called opposition or opposition group of Modi ji.

Every citizen of the country has the right to appeal to the Prime Minister for his suffering and his diagnosis, are the pensioners also senior citizens of the country or not. Yes one thing is true that many shops have opened in the name of this suffering, sadly they are the people among us who will not be benefited to teach the lesson of morality.
