Good News For EPS 95 Pensioners: सुप्रीम कोर्ट का एक फैसला और पेंशन की लिमिट ₹15000 से बढ़करहोगी पूरी सैलरी EPS 95 के तहत होगी कई गुना पेंशन बढ़ोतरी, मिलेगी 25000 रुपए तक पेंशन

कर्मचारी भविष्य निधि संगठन (EPFO) के लगभग 6.5 करोड़ सब्सक्राइबर्स के लिए बड़ी खबर है।  आपके पेंशन फंड की सीलिंग को लेकर सुप्रीम कोर्ट में 24 अगस्त को बड़ा फैसला हो सकता है।  मामला अभी सुप्रीम कोर्ट में है और लगातार सुनवाई चल रही है।  EPFO के सूत्रों की मानें तो सरकार ज्यादा से ज्यादा लोगों को PF के दायरे में लाना चाहती है।  मामला पेंशन के लिए 15000 रुपए की बेसिक सैलरी पर सीलिंग का है।  मौजूदा नियमों के मुताबिक, EPS पेंशन में 15000 रुपए की लिमिट है।  ऐसे में पेंशन फंड में हर महीने अधिकतम 1250 रुपए ही जमा हो सकते हैं।  कुल मिलाकर अगर सीलिंग पर फैसला होता है तो सीधे तौर पर बेसिक सैलरी की सीलिंग बढ़ जाएगी।  इसे 25000 रुपए किया जा सकता है।

बेसिक सैलरी की सीलिंग?

EPF कॉन्ट्रिब्यूशन के लिए इस वक्त 15000 रुपए बेसिक सैलरी की सीलिंग है।  इसे बढ़ाया जा सकता है।  अगर किसी व्यक्ति की बेसिक सैलरी 30000 रुपए है तो उस सैलरी पर उसका 12 फीसदी कंट्रीब्यूशन प्रोविडेंट फंड (Provident Fund contribution) में जमा होता है।  इतना ही शेयर एम्प्लॉयर (Employer) के खाते से भी होता है।  लेकिन, एम्प्लॉयर के हिस्से को दो जगह जमा किया जाता है।  पहला- EPF और दूसरा- पेंशन (EPS)।

EPS 95 पेंशन कोष में सिर्फ 15000 रुपए का 8.33 % यानि 1250 रुपए जमा होते हैं

एम्प्लॉयर के 12 फीसदी हिस्से को भी 30000 रुपए की बेसिक सैलरी पर ही जमा होगा।  लेकिन, पेंशन फंड में बेसिक सैलरी की सीलिंग 15000 रुपए है।  लिमिट होने की वजह से बेसिक सैलरी (15000) का 8.33 फीसदी हिस्सा सिर्फ 1250 रुपए ही जमा होता है।  लिमिट बढ़ती है तो ये हिस्सा 25000 रुपए की सीमा पर तय हो सकता है। मतलब 2083 रुपए पेंशन फंड में जमा हो सकेंगे।

30000 रुपए के हिसाब से मौजूदा स्ट्रक्चर को समझें

बेसिक सैलरी- 30000 रुपए

कर्मचारी का कंट्रीब्यूशन- 12 फीसदी के हिसाब से 3600 रुपए

एम्प्लॉयर का कंट्रीब्यूशन-12 फीसदी का 3.67 फीसदी के हिसाब से 2350 रुपए

पेंशन में कंट्रीब्यूशन- 8.33 फीसदी के हिसाब से 1250 रुपए

सीलिंग बढ़ाने पर हो सकता है फैसला

EPFO के एक ट्रस्‍टी केई रघुनाथन के मुताबिक, मौजूदा वक्त में बेसिक सैलरी की सीलिंग 15 हजार रुपए है, जिसे बढ़ाकर 25 हजार रुपए तक करने का प्रस्ताव काफी पहले रखा जा चुका है।  सुप्रीम कोर्ट में अब इस मसले पर फैसला होना है।  अगर फैसला बढ़ाने पर आता है तो निश्चित तौर पर पेंशन की रकम में इजाफा होगा।  पेंशन फंड बढ़ने के अलावा दूसरा फायदा यह भी है कि बेसिक सैलरी सीलिंग के ऊपर जिन लोगों की सैलरी है, उनके लिए PF का कॉन्ट्रिब्यूशन वैकल्पिक होता है।  ऐसे में अब इस दायरे में ज्यादा लोग आ पाएंगे।

6.5 करोड़ लोगों को मिलेगा फायदा

कर्मचारी भविष्य निधि संगठन के रिटायर्ड एन्फोर्समेंट ऑफिसर भानु प्रताप शर्मा के मुताबिक, अगर यह फैसला होता है तो इसका फायदा 6.5 करोड़ EPFO सब्सक्राइबर्स को मिलेगा।  पहला ये कि ज्यादा लोग इसके दायरे में आएंगे और दूसरा एम्प्लॉयर का शेयर बढ़ेगा तो पेंशन फंड (Pension fund EPS) में भी इजाफा होगा।  हालांकि, अभी इस फैसले को अमल में लाने के लिए समय लग सकता है।

यूनिवर्सल मिनिमम वेज का फॉर्मूला

सूत्रों की मानें तो सेंट्रल बोर्ड ऑफ ट्रस्टी (CBT) के मेंबर्स Pension fund पर लगी लिमिट को बढ़ाने के पक्ष में हैं।  इसके पीछे दो तरह की दलील हैं।  पहला- देश भर में जो यूनिवर्सल मिनिमम वेज (Universal Minimum Wage) का फॉर्मूला लागू किया जाना है, उसमें सैलरी 18 हजार रुपए के करीब निर्धारित की जा सकती है।  ऐस में जो मौजूदा सैलरी सीलिंग है, उसमें बढ़ोतरी करने की जरूरत है।  इसके जरिए ज्यादा से ज्यादा लोगों को EPFO में लाने में मदद मिलेगी और सोशल सिक्योरिटी बढ़ेगी।

Good News For 67 Lakh EPS 95 Pensioners: लोकसभा के आगामी मानसून सत्र में EPS 95 पेंशन को 7500 बढोतरी समेत महंगाई भत्ते के साथ अन्य मांगे उठाने मिला ठोस आश्वासन, EPS 95 पेंशनधारकों में खुशी की लहर

जैसा कि सभी EPS 95 पेंशनधारकों को अवगत है कि पिछले कई सालों से EPS 95 पेंशनधारकों की पेंशन बढ़ोतरी के लिए लगातार प्रयास किया जा रहा है, पर अभी तक EPS 95 पेंशनधारकों की पेंशन बढ़ोतरी नहीं हुई है। इसी को देखते हुए EPS 95 पेंशनधारकों की पेंशन बढ़ोतरी के लिए राष्ट्रीय संघर्ष समिति मुरादाबाद मण्डल के पदाधिकारियो द्वारा EPS 95 पेंशनधारकों की न्यूनतम पेंशन को ₹1000 से बढ़ाकर ₹7500 किया जाए तथा उसे महंगाई भत्ते के साथ चिकित्सा सुविधाएं दिलाने की मांग को लेकर मुरादाबाद के माननीय सांसद एस. टी. हसन साहब को ज्ञापन सौंपा गया है।

माननीय सांसद महोदय ने समस्त EPS 95 पेंशनधारकों की जो मांगे हैं जिनमें EPS 95 पेंशनधारकों को न्यूनतम पेंशन ₹7500 दिया जाए साथ ही उसे महंगाई भत्ते के साथ भी जोड़ा जाए और यदि आवश्यक है तो बजट में प्रावधान किया जाए, इसके लिए कानून पास किया जाए। यह उचित मांग कोशियर समिति (राज्यसभा पिटिशन 147) के अनुसार महंगाई भत्ता 7 से 8 वर्षों में बढ़ी हुई महंगाई को देखते हुए की गई है।

उसके बाद EPFO द्वारा 31 मई 2017 को जो अंतरिम पत्र जारी किया गया है उसे वापस लेकर ईपीएफओ के परिपत्र दिनांक 23 मार्च 2017 के अनुसार उच्च पेंशन प्रदान किया जाए।

उसके बाद सभी EPS 95 पेंशनधारकों तथा उनके पति या फिर पत्नी को मुफ्त चिकित्सा सुविधा दिए जाए यदि स्कीम में प्रावधान नहीं है तो कृपया प्रावधान करवाएं, नियम कानून सभी के लोक कल्याण के लिए होते हैं।

उसके बाद जिन सेवानिवृत्त कर्मचारियों को EPS 95 पेंशन योजना में शामिल नहीं किया गया है उन्हें उसका सदस्य बनाकर योजना में लाया जाए अथवा उन्हें ₹5000 की राशि पेंशन के तौर पर दी जाए। देश में ऐसे निवृत्त कर्मचारियों की संख्या बहुत ही कम है, जिनको पेंशन दी जा सकती है।

माननीय सांसद महोदय ने इन सभी समस्त मांगों को विस्तार से सुना तथा उनकी गंभीरता को समझते हुए उक्त मामले को लोकसभा में रखने का आश्वासन दिया है। EPS 95 पेंशन वृद्धि के लिए ज्ञापन प्रस्तुत करते समय प्रतिनिधि मण्डल में श्री डीके सिंह मण्डल अध्यक्ष, सुश्री मंजू लता सक्सैना मण्डल अध्यक्ष महिला मोर्चा, रमेश चन्द्र त्रिवेदी जिलाध्यक्ष, श्री. मटरू लाल समन्वयक एवं श्री राजीव शुक्ला सचिव और रामसरन शर्मा उपाध्यक्ष मुरादनाद एवं श्री प्रदीप अग्रवाल जिलाध्यक्ष सम्भल मुख्यरूप से उपस्थित रहे और सेवा निवृत EPS 95 कर्मचारियो से सम्बन्धित समस्याओ से सांसद महोदय को अवगत कराया गया आदि प्रमुख रूप से उपस्थित रहे।

All EPS 95 Pensioner have been waiting for Hon'ble Supreme Court to start after vacation on 1st July 2021. We are with a hope that the Apex Court under present CJI Sri.N. V. Ramana ji will settle our EPF full higher pension case favourably in our favour. Everything left to GOD only. Whether it is right or not many of my colleagues comments that though Hon'ble SC delivers favorably it will be applicable to those who have petitioned in court but not for all.

Here what I want to say owing to many personal difficulties many might not have filed writ in the court. That means they have to forget. We have no hopes with present Govt. Which is adamant may not realise our difficulties and not helped even in corona PANDEMIC period as extended to others.

The Govt is playing in the court with fake liability of required funds to the tune of 15 lakhs crores. It is quiet wrong. Our strength is also reducing due to many are reaching GOD. As per rough statics of actual strength of existing EPF pensioners are as follows. Right from the release of SC verdict date 4-10-2016 till now more than 2.5 lakhs have left the world.

That means 67 - 2.5 = 64.5 lakhs

Actually all may not claim full higher pension either less than sealing pay and may not contribute difference of contributions with interest. They all come up to 40%. that means roughly 27 lakhs.

Remaining are 64.5 - 27.0 = 37.5 lakhs only.

If the above rough estimate is correct the net required funds by the Govt may be hardly 5 lakhs crores including arrears.Despite difference of contributions paid by pensioners. So we hope for positive verdict for all.

By GOD's Grace due to the elections in Punjab Delhi and UP if Modi Govt shows sympathy for minimum pension of Rs.7500.00 with DA as demanded by NAC is sanctioned all of us will be benefitted as those who are drawing higher pension prior to the year 2005 are also anticipating minimum pension with DA.

You will be astonished to know that in the year 2021 i.e., in about 6 months, EPFO has filed 965 Review Petitions (list attached) in the Kerala High Court.  Without any doubt, this can be inferred that EPFO seems to have filed Review Petitions in r/o all the WPs which had been decided against EPFO by the Kerala High Court (there might be some cases not relating to pension on higher wages)

Apart from above, 5 Writ Appeals have also been filed by EPFO in 2021.  Not sure as to whether these are relating to Writ Petitions regarding EPS’95 (Pension on higher wages).  List of some Writ Petitions filed in 2021 is also attached.

We are getting number of phone calls from our pensioner friends regularly to know d status of higher pension matter. so we would once again wish to  infom that d matter is now pending in Supreme Court for hearing n order. court will open on 1st july. thereafter our dealing advocates will take steps for early hearing of our cases.

In d mean time our Assn has send a petition to CJI for early hearing of our cases n our friends of Telengana state has also met CJI at Hydrabad discussed with him n has given a representation for early hearing of our cases. we are also in regular touch with our NCR leaders at Delhi about d case matter n they are taking all steps. we are hopeful that d matter will be taken up in july for hearing.

Eminent lawer Sri Kapil Sibal ji will plead our case as understood from Gurmukh Singh ji earlier .our dealing advocates are read for hearing of d cases n sufficient data has been given by Praveen kohli ji to advocates to counter d stand of EPFP. most unfortunately Central Govt is fighting against us to deprive d poor EPS-95 pensioners from getting higher pension to meet food n medicine expenses at d last stage of their life in spite of orders of Supreme court n many high courts. so friends we have to wait for some days for d decision of Supreme Court.

Dear friends, Greetings to all.

The Supreme Court is scheduled to open from 01-07-2021 Thursday, after vocational holidays.

1. The justice Mr.UU.Lalith is posted as ‘National Legalised Authority’ for the support and help of poor and other needy people to provide law support, and will be relieved from the present bench.

The 3 judges bench headed by Mr.UU.Lalith will be re arranged soon.

2. As you all may be well aware that our team of Advocates were on the job and after the final submission by our Advocates as directed by Mr.UU.Lalith bench, (7 Page reply to EPFO’s 661page affidavit) the case has been a fantastic turn towards-pensioners side and all the averments put forth by the EPFO were found to be bogus and not maintainable.

3. In view of the Kerala High Court judgments in RP. 267of 2021 in WPC 26944 of 2019 Dated 08-04-21 and RP.276 of 21 in WPC 30210 of 19 dated 09-04-2021 the review petitions cannot be filed as per law. Hence the same rule is even applicable to SC too and in all fairness SC will also reject the review petition, pending before SC. (kindly go through the judgments in this regard circulated to all)

4. In fact the EPFO and Govt. Advocates Mr.KK.Venugopal and Mr.Aryama Sundaram were briefed by one of our AORs personally regarding their wrong footing in the subject heading Finance matter and further seem to have pointed out that their rejection of enhanced pension was wrong and against Law.

5. The latest Madhya Pradesh High Court Order dated 08-06-2021 is very clear that the word jubjudice is for both petitioners and EPFO. Stoppage of revised pension, when the case is pending is highly condemnable, accordingly the PF Commissioner was fined Rs.5,000/- for the stoppage of enhanced pension and directed to reconsider the revised pension within 15 days. (MPHC judgment posted)

In another case the MP HC directed the EPFO authorities to consider revised pension to the Widow of expired pensioner vide WP. 25459 0f 18 dated 30-11-2018. (implementation portion is not known -old case)

6. As you know the meeting held with the Hon’ble Chief Justice Mr.NV.Ramana at Hyderabad Rajbhavan through our Telangana all pensioners and retired persons Association president and other leaders will definitely fetch a remarkable turn in our case in favour of petitioners. Thanks to the Association executives of Telangana.

7. In Madras High Court, the JAC Executives making all arrangements to face the case, after the normalcy is restored after Corona effect.
