EPS 95 HIGHER PENSION CASES ORDER: RECORD NOTE OF DISCUSSIONS WITH AOR SHRI PURSHOTTAM TRIPATHI ON 14.12.2022 IN SUPREME COURT ADVOCATES’ CHAMBER

A meeting took place regarding our EPS'95 Pension Case yesterday. S/shri Ratish Maurya, Vijender Kumar, Satish Mehta, V.K. Tomar, HM Mallesh and about 15 members of NCOA working group from Bangalore attended the meeting.

It was informed that clarification/modification application by other parties in the Supreme Court has already been filed apart from Review Petitions and the Court has fixed 16th December 2022 for hearing.

After hearing the following three points may emerge:

a) Court hears the clarification application moved, may issue necessary clarification in our favour i.e., clarifying that pre-2014 retirees are covered in R.C. Gupta judgement. In such case there is no further action required to be taken at present.

b) Court hears the clarification application and decides against us, then we can file our joint option as per format likely to be declared by EPFO with suitable guidelines by the end of this month. In case our joint application forms are rejected by EPFO, it will give us further cause of action to file a fresh Writ Petition for suitable remedy.

c) Court admits the clarification and issue directives to EPFO/ GOI to furnish their written submission on the issue. It will be the last day on 16th December before winter vacation and we shall have enough time for joining the clarification application and we can also join the same 

d) We had discussed earlier that review petition will not give us any benefit, on the contrary it may prejudice attitude against us.

2. Another issue which came up for discussion is that in case pre - 1.9.2014 retirees average last month salary shall be calculated on the basis past 12 months salary average but in case post 1.9.2014 retirees same shall be calculated on the basis of last 60 months salary average.  

For post - 1.9.2014 retirees what should be our course of action?

AOR advised that first we should avail of whatever has been offered, enjoy the same for some time and then file a suitable Writ asking for the rectification of this anomaly. EPFO has justified with arguments that average of 60 months will be more beneficial to small Private Sector employees but it is not in the case of Public Sector Employees as their salary increases every year with increment & DA.

पेंशन अदालत मौजूदा और भावी पेंशनभोगियों को EPS 1995 के प्रावधानों को समझने और पेंशन न मिलने, डिजिटल लाइफ सर्टिफिकेट आदि जैसी उनकी पेंशन संबंधी शिकायतों के समाधान के लिए EPFO अधिकारियों के साथ घनिष्ठ बातचीत के लिए एक मंच प्रदान करती है।

सभी हितधारकों को उनकी शिकायतों के त्वरित निपटान के लिए और/या EPFO से संबंधित किसी भी समस्या का सामना करने के लिए उपरोक्त कार्यक्रम में भाग लेने के लिए आमंत्रित किया जाता है।

यहां जारी एक आधिकारिक बयान में कहा गया था कि यह स्थान ईपीएफओ क्षेत्रीय कार्यालय, रेलवे रोड, जम्मू, 180012 सुबह 10.30 बजे से आयोजित होंगी।

EPS 95 Pensioners Latest News: Cases registered by the Human Rights Commission for not implementing the Supreme court judgement dtd 4 11 22 by EPFO

Following cases registered by the Human Rights Commission for (1) not implementing the Supreme court judgement dtd 4 11 22 by EPFO for pension on higher wages/salary under EPS 95 pension scheme (2) option of excercising  11(3) and 11(4) in between employee and employer for pension on higher salary.

Karnataka SHRC has registered a case no. 4208/10/11/2022 on the complaint regarding Vishwanath Wali.-HRCNET,NHRC

• 1. EPFO has implemented EPS 95 pension scheme from 16/11/1995 to their pf members.

• 2. Employee contributing 12% of their basic salary and employer is also contributing equal amount to the EPFO.

• 3. Out of employer contribution 8.33% transferring to EPS 95 pension by EPFO. But EPFO is transferring 8.33% on ceiling salary of RS.5000,6500 pension account and difference to members pf account.

• 4. On ceiling salary pension will be getting on retirement a very minimum amount of RS.500,600...etc.

  5. Our demand is pension is paid on actual salary instead of ceiling salary.

• 6. Accordingly Some of pensioners filed suit in High court for pension to be paid on actual salary.

• .7. High court judgement made in favour of pensioners as pension will be on actual salary.

• 8. EPFO have disagreed the High court judgement and made appeal with Supreme court.

• 9. Supreme court judgement made on 04/11/2022 upheld the High court judgement

• 10. EPFO have still not implemented the decision of Supreme court judgement so far.

• 11. Hence the complaint made with Human Rights dept.
